    16 year old assaulted by 17 year old/organized crime

    I am 16 years old, my 'friends' led me down the street and all of a sudden i see a guy that really wanted to beat me up, and he's threatened me on Facebook a couple of times. The guy runs up towards me and starts punching, kneeing, and elbowing me in the face, and all over my torso and tears off my shirt. They all walked home, and i followed them and every few seconds he would turn around and say "turn around or ill beat you up again"

    I called the police and they sent me to the hospital, i had a concussion, cuts on my lips, several swollen areas on my head, and a scratched up body, but the cops let him go.

    After I got home, i looked on facebook and he uploaded a picture of himself putting his thumbs up and smiling with my ambulance in the background, the caption said "Ali's ride home". He also posted on another person's wall on facebook saying something about beating me up. In the comments another boy threatened that he was going to beat me up next.


    The guy who beat me up is 17 years old, could the other kids be charged with organized crime? And could any of them be charged for taunting me on facebook?

    You need to re-contact the police who took the original report and give them the information.

    i'm going to talk to the detective tomorrow, what can he be charged with? and he turns 18 tommorow, are we both minors?

    Assault, just like an adult. Different states have different laws. He may or may not be charged as an adult. The detective can explain all of that tomorrow. Just take all the evidence you have with you when you see him.

    In Connecticut, it doesn't matter how old you are when you are arrested, it only matters how old you were when you committed the crime. If he is arrested for assault he would likely be charged as a minor here. I don't know what state you are in.

    In Oregon, it's really up to the prosecutor and the juvenile court judge. I've seen a lot of kids charged as adults over charges like this when they were that close to 18. This could be considered a felony assault, if so someone as young as 16 can be tried as a adult here for it.

    PA allows us to " Direct File " some of the more serious charges against a kid 14+ without the DA's approval. Then it is up to the kid to try to get the charges knocked down to Juvenile Court. Agg assault is one of those charges , along with murder , robbery , rape etc.

    The sections of the law are CLEARLY spelled out so it is not a blanket of cases.

    If you want to share; Why are these people doing these things to you? You answer may matter. For instance a crime such as "Hate Crime" (prejudice).

    No. Why should Facebook taunts be any different than what happens in real life before/during/after school? Do you expect people who pick on you in the lunch room to be arrested?

    I don't. I worked them for three years. Attacking someone because of something they can't help or change (skin color, religion, etc) sucks.

    When I taught in the academy, I used an example of when I was a first grader in W. Texas. My mother bought me a wool coat that went down below my hips. The first day I wore it to school, some kid remarked that I was wearing a girl's coat..... At 6 years old, them's fightin' words and I got into several fights on the school grounds that day. I came home and told my mother that I wasn't going to wear that coat anymore and why. She was surprisingly good about it and although we didn't have much money, bought me another. The next day I wore it and no one said a word.

    I could change my coat and no one picked on me, but I wouldn't have been able to change my skin color. Also maybe growing up in a racist, segregated Texas had something to do with it too. As a kid, I saw black people subjected to sh!t just because of who they were, not a damn thing that they had done. And rarely is it one on one, it's nearly always a bunch of cowards attacking one, maybe two people.
