    Got a MIP yesterday, need some answers.

    alrighty, well yesterday i got screwed. My "sober" friend who drove me and another friend home got pulled over and the officer knew that he was drinking. We all had to take breath analizer tests, i blew above a 0.1.

    Since im only 17 im going to juvenile court. He didnt write me a ticket, so will i get one in the mail? How long does that usually take? I can't afford to lose my liscence, if i do i lose college and 2 jobs. This is my first offense. I heard that im just gonna get fined since it is my first offense, but then i heard that WA state is hardcore when it comes to MIPs and will suspend your license for up to 2 years. Whats true? What do you think is gonna happen? I need answers ASAP. Thanks

    Don't know about WA state but in CA you would lose your license for a year. If college and 2 jobs was so important to you, why were you drinking and riding with someone who had been drinking?

    didn't know that he was. How do other people with MIPs get off with not getting their liscence revoked? Does it matter at all that its my first offense?

    What state are you in? In Minnesota, you don't get your license suspended unless you were the one driving.

    In PA you would get a $300 fine plus a 90 say suspension of your license. Doesn't matter if you were driving or not. You gambled and LOST, time to pay up.

    were you in posses or did you just blow 0.1 in texas you would be p.i. thats a class c misd dont know about wa i dont see how they can give you a posses if you did not have it on you

    In St. Louis, you could get a $500.00 dollar fine and do 90 days in the workhouse. Also, MO law makes you an adult at 17 for criminal purposes.

    If juvy court is anything like it is in my area you probably could get a slap on the wrist if you say the right things to the judge. Tell him or her that you will lose your job and will be unable to attend college if you lose your license. Also explain that this is your first offense and that you learned your lesson.

    I would really hate to see a kid lose his chance to attend college for a simple MIP, something that alot of cops and judges did in their youth.

    from my experience with a dui ( i live in california), the court can enforce the revocation/suspension of your license however that is just one of many punishments. the other problem you have to face before you will get to your hearing is the dmv. they file a revocation/1 yr suspension of your license that is seperate from your court criminal charges. in california, you will have to schedule a meeting with the dmv and i would recommend a lawyer. if you tell them you have bills to pay and are dedicated to getting your education (and it depends on having your car) they will give you a conditional license.

    thats exactly what i was gonna do, because i actually did learn my lesson. I live in washington state, and no we didn't have any alchol on us... just in our breath :( thanks for all the replies, you guys are helping a ton

    I would also make sure that you offer no excuses on your behavior. If asked why you did the act, a simple, "I made a bad decision a learned from it" statement should do. Judges hear excuses for everything, on how it wasn't their fault they did...... . Also, put on your best, most professional outfit you have, shave, and get a haircut. Image holds some weight in front of a judge.

    maybe i read your first post wrong, but, did you say you didnt get a ticket? i dont see why he would mail you one if he already had you in the car. WA must have different laws concering MIP. you would probably be public intox here, but without any alcohol in your possession, MIP seems kinda weird for a charge. did your buddy get a ticket or charge?

    nope i didn't get a ticket, he said since i was 17 they would have to forward it to the juvenile court or something. They haven't called yet. One of my friends got a ticket, and I haven't talked to the driver yet, but i can imagine that he also got a ticket. Yes, once again, we had not alcohol in our possesion

    In Washington juveniles will not receive a criminal citation except for driving offenses. A report will be sent to the servicing juvenile court and a summons will be issued for the suspect to appear for his/her araingment which will come in the mail.

    MIP/MIC is shorthand for the charge. It is under RCW 66.44.270.2(a) and (b) which state it illegal to "posses, consume or acquire" or "exhibiting the effects of consuming alcohol". Smelling the odor, admitting to drinking, registering a reading of .01 or higher on the PBT are all that is needed to arrest for and charge for this offense.

    If found guilty suspension will range from 90 days to a year depending on history.

    Washington does not have a state public intoxication statute

    does it state in the law pbt? pbt's are not admissible as evidence by the prosecution in court.
