    Unlawful sex with minor...

    When I was 13, I had sex with a 28 year old man. Although I didn't feel right about the situation, Consented anyways. This happened on 2 separate occasions. Afterwards, I put it out of my mind, became depressed, became an addict, cut, and became rebellious. I've struggled through out the past few years, But now I have 3 years 8 months clean, have 2 jobs, I'm doing my best to be a productive citizen. Even though this happened 14 years ago can I still press charges? I just want to close this chapter in my life, plus I have a 3 year old daughter who I need to protect. I know that I can't put all the sexual predators in jail, but if I can help put this one away, that's one less I have to worry about coming after my daughter.

    It depends on the statute of limitation in the state where it occurred. In Oregon, you have until you're 24 to prosecute a sex crime against you when you were under 18.

    Congratulations on 3 years, 8 months! Way to go!

    Back to topic, I would suggest you get some therapy to help you deal with it. That will do more to put closure on it than sending him to jail. Common sense on your part and good values taught to your daughter will do more to protect her also.

    Hello Kitkat84,

    This is such a serious offense that you should not rely solely on any answer from this forum. I strongly suggest you contact the law enforcement agency where the crime was committed. The officer or detective will most likely consult with the DA's office with jurisdiction for definitive clarification. Irrespective whether this particular offense can be prosecuted the law enforcement agency and district attorney's office should be made aware.

    From memory only I believe the statute of limitation for certain sex crimes and for crimes punishable by eight or more years in prison is six years after the crime's commission (or discovery) and in some cases even ten years with some sex crimes. You must understand there are several exceptions to this general rule, therefore you should consult with a law enforcement officer so your case can be investigated and evaluated by proper authority.

    We had one member who, while no longer here, said she had the same thing happen and successfully aided in prosecuting those who took advantage of her at such a young age.

    First things first. Due to your age at the time this offense occured you did not "consent" to a sexual assault. Please don't think for one second that the fact that you were present at the time of the assault equals you consenting to anything.
    Second, consult with local law enforcement to determine the amount of time you have to file an offense. There have been lots of changes with regard to statue of limitation on sex assault to minors.
    Third, speak with a professional counselor about these issues that have been with you.

    Thank you everyone for all your responses. After further research, I discovered that I have passed the SOL. It's 8 years after the age of maturity or before the age of 26. Unfortunately, my 26th birthday was in April. As far as therapy is concerned, I've been there done that. But therapy or not, this will always be in the back of my mind. I've gotten past all the anger and sadness. As the saying goes, what doesn't kill you, makes you stronger.

    Did you read Gutwrench's post regarding the several exceptions to the statute of limitations? You really should call rather than relying on your own research about this.
