    Hi. My grandparents were out of town and my brother broke into their house with his friends. They drank their alcohol, smoked weed and cigatettes in their house and broke furniture. They also went through all their closets, drawers ect. They totally trashed their house. My dad busted them the next morning. The police were not contacted. A few days later my mom busted my brother and his friends stealing money from my grandparents house. They got in the house by using a credit card. Once my grandparents got home and seen the damage, they wanted to press charges. The only evidence they have is their broken furniture, sheets with someones "stains" on them, missing change, and photos of some of the kids in their basement. What can she get these kids for?

    In my state, assuming they were under 21 and based solely on your description, the very worst they are looking at is:

    1. Burglary (a felony)

    2. Minor in possession of an alcoholic beverage (a misdemeanor)

    3. Possession of marijuana (an infraction)

    4. Vandalism (a misdemeanor or a felony depending on the dollar amount of damage)

    5. Conspiracy to commit the above offenses (a felony)

    Because this happened on multiple dates, there would be separate counts of each crime for every day on which it took place.

    FWIW, doing this to a relative is a horrible breach of their trust. I don't blame your grandparents for pressing charges.

    In my state, burglary of a residence is punishable by up to six years in state prison for each count. If the damage done by vandalism is more than $400, the punishment is up to one year in state prison and up to a $50,000 fine for each count. Each count of Conspiracy to commit a crime is given the same punishment as would be met out if the crime was actually committed.

    Each Misdemeanor can be punished by up to one year in the county jail.

    The "only" evidence? How about the fact that the father witnessed them in the house? In TN it's aggravated burglary, which is a felony. There's plenty of evidence to obtain a warrant for applicable charges in whatever state you're in.
