Now to your question.
Rather than tell us one sentence of what happened , how about the whole story ?
Possible scenario #1 You and your uncle were engaged in a mutual fight and you both get arrested.
Possible scenario #2 You just got done beating the living daylights out of his his wife and he came to her aid.
Possible scenario #3 You told him that he is a low life $&*$&*$& and that he likes men better than women.
I could go on all day with this.

hah ok soo they are in a parking lot and they get into a verbal disbute about her talking to a boy. she says go to &*%$ and he punches her, causing her lip to bleed. a nearby officer sees this happening and is in hearing distance so he heard what what said, what happends to the uncle, the girl is not a minor btw.
So what did the officer do (or not do)?

im just curious what the officer would go about doing in a situation like this, he would arrest the uncle right?
First of all, doesn't sound like you're writing a story, so I moved this to the regular Ask-A-Cop section. If I'm wrong, let me know and I'll move it back to the Writers Questions section.
In Florida, if the officer saw that happen, and was within earshot, he/she would definitely investigate. I'm assuming since the story is still kind of vague, that there were no weapons involved and that the bloody lip would not lead to permanent disfigurement. If that is the case, it would be a charge of Misdemeanor Battery. Now the twist, once I found out both were related by blood or marriage, it would become a case of Domestic Violence (DV), and an arrest would be mandatory. If the "uncle" was just a friend that the girl called "uncle", then it would be up to the victim to swear out a statement and press charges. If not DV, I could would only arrest if the victim pressed charges.

In PA , it would amount to a non-traffic citation for Harassment. max of $300 and or up to 90 days.

How about you tell us what the officer did or didn't do and we will elaborate? Keep in mind that we will not berate or knock an officer's actions based on one side of the story.
the officer went over to the man,read his miranda rights, hancuffed him and put him in the car. What would happen with the uncle? thank you![]()
Sounds like he was arrested. Did he drive off with him to jail or cite and release him? Either way, the uncle would have to appear in court and you would have testify against him at some point.
