    Really need to know can someone help?

    Okay so my boyfriend had just got off of work at midnight and he lives about 20 miles from work, well he makes it home he lives on a dirt road owned by the department of water or something like that, well anyways he pulls up to his gate there's an indention in the fence for where the gate is so where he pulled up was his private property as soon as he stops to get out and open the gate lights flash behind him... The officer said they had seen a similar car at a bar, but they followed him without even there headlights on all the way til his house, then continued to write him a ticket for driving on a suspended licsence.

    Okay back story time, please bear with me need some advice badly.
    Maybe a month ago he joined up with his friends and had some drinks, no he wasn't driving well he got dropped of at his car which was parked outside his friends house no more than literally a stones throw away from his own home, he gets into his car because his friend had already gone inside and locked the place up, now where he lives gets down to about 30 degrees at night and he knew he was too drunk to drive anywhere no matter how close so he turned his car on to get the heater going because he was freezing and just wanted to get warm. Well he ends up falling asleep and a few hours go by, then an officer comes along and proceeds to call two cruisers and I think it was like three CHPs, which one of the CHPs gives him a field sobriety test and breathalizer and they give him a ticket for a DUI, I've heard it doesn't matter if you're driving or not, if you're drunk and the key is in the ignition its a dui. Well the first officer to arrive told him he could drive to work and back and that was it, provided he should have got it in writing. Well he called the DMV a few times to see if his license was suspended or anything like that because he didn't want to drive if it was and get in trouble for doing so and every time he called they said no so he thought nothing of it, but then this officer does this oh by the way there was another officer following him, as well.


    So basically I'm confused, he was told by a police officer he could drive to and from work, he checks with the dmv to make sure his licsence isn't suspened so he doesn't get a ticket for it. But when he comes home from work and is on his own property on a road not owned by the county, when he hadn't done anything but had a similar car to one that was at a bar, he gets a ticket..for having a suspended license when he hasn't even finished the court matters for the dui and didn't know it was suspended.

    Can an officer do this? Following with out headlights? Two cruisers mind you, and all the above mentioned, please I really need some advice he's never had not a single blemish on his driving or criminal record until he fell asleep in his parked car... I need to know if it's within the law for an officer to do this.

    THANK YOU G35, that is all I wanted to know I already knew they did there job when he got his dui I was asking about the suspended license ticket so thank you for answering my question I greatly appreciate it.

    I am not required to obey traffic laws while working to enforce the law, hence, it is fine for me to drive w/o my headlights on. If your boyfriend was followed from the bar and then pulled over when he got to his house he was still operating the vehicle on the public roadway without a license; it doesnt matter where the stop took place.

    Why are you so concerened about officers following him? It is not against the law for an officer to follow a car around and if your boyfriend was obeying the law he wouldnt have anything to worry about. Also he probably lied to you about checking with the DMV to see if his DL was valid. Believe it or not some people lie to other people.

    Also, your writing makes no sense at all....you didnt happen to be one of the writers from LOST did you?

    JR, see I didn't know officers could do that for thank you for clearing that up.

    He wasn't driving from a bar he had gotten off work and went home the officer told him the reason they stopped him was because they had seen a similar car leave from a bar. Which makes sense for them to follow him if they thought it was a drunk driver. Look I don't care about them following him I was just stating everything that happened that's all. I know very well an officer can follow someone. Yeah he didn't think he had anything to worry about because 1. he didn't know his license was suspended. and 2. the officer said he could drive to and from work.

    Wow I must have worded it bad but I am seriously worried and rushed typing it because I was eager for an answer.

    I was with him when he called the DMV they checked his record they said it was fine, how can one officer say you can drive to and from work only but then get a ticket for doing what the officer who gave you the dui said?
