    harrassement

    Hi I live in CT and want to know following regarding getting a restraining order. Husband cheated with woman. She has called me twice asking that I call her. i blocked number and she called my work and said if I didn’t want her to keep calling I just needed to call her back. She called my home to say she knew where I worked and lived and just wanted to talk. I don't think she intends any harm, but I just don't want to speak with her. She also sent an email initially to inform me of affair. Fearing she might continue to call, I called her and informed her not to call again. She said she had no intention, but I wanted to know if I should /could get a restraining order. When I called her she was rude, but not threatening. I do have two young children. I am not particularly afraid, just want to be left alone. She called me twice and sent an email. I called her twice. Really once, but she said she didn’t want to talk to me and she hung up. I called back to say please don’t call again or I would file restraining order. IS this enough for a restraining order? Thanks for your help.

    Here you can only get one on a current or former partner/spouse or family member.

    You told her to stop, if she doesn't then call the police or call them anyway just to report it. Here we usually give them the final warning. Even if you were eligible for a restraining order, the fact that you aren't really afraid and that she didn't threaten you would make it unlikely they would grant one.


    I'm sure someone from CT will be around to better answer though..

    First of all, Welcome to RP from the Florida Panhandle. Usually we ask that our newest members of the board go to the New Member Introductions forum and post a thread about themselves as coming into our little home here on the internet and just hammering us with questions is considered bad form.

    As for answering your question, as I do not enforce the laws in CT, I can only answer for how it would go down in FL. From what you've said, it seems as if there has been no crime committed by either of you two as far as harassing communications because she stated she does not intend to call you any more. So, as for getting a restraining order, you could always go to the local Civil court and ask for one, but I don't see a judge granting it to you based on the limited contact you two have had, especially when you tell the judge that she has informed you she has no intention to contact you again.

    Also, please try to post in the correct place from now on. You posted this question in the Ask-A-Cop: Writers Questions sub-forum. I have moved it to the regular Ask-A-Cop section.

    I assume you're getting a divorce? If so, talk to your lawyer about the situation and see what they say. Sometimes a threatening letter from one does wonders.

    Beyond that, unless Ct. has different laws, most states are like what Greg said. You can only get restraining orders from someone you've actually lived with.

    I believe in Florida you can request a restraining order against ANYONE. A Domestic Violence Injunction (DVI) would be a restraining order against someone who you have lived with as a family, are related to, share a child with, or were/are married to. Now, whether the judge grants a restraining order against just anyone is another thing altogether.

    In Oregon, it would have to be a stalking order if there was never a domestic situation. I don't think the case presented by the OP would meet that standard.

    In Connecticut you can get a restraining order on anyone.

    For telephone and email harassment, what needs to happen to get a restraining order is that, first of all, you need to tell the other person to stop contacting you. If they don't stop then you can call the police and report the harassment. Once you have obtained a police report (or a report number, since the actual report will not be immediately available) you go to the local superior court and to the court clerk's office. Ask about obtaining a restraining order and they will be able to assist you.

    However, I doubt that your case would be sufficient to obtain a restraining order. From the post you wrote it sounds like you called her twice and she called you twice. Neither person appears to be harassing the other. You even specified that you don't think she intends to do any harm, so two phone calls would hardly rise to the level of harassment.

    Your post indicated that you called her and told her not to call again and she said she had no intention to call again. And, from what you wrote, she hasn't called again. I'd say let it lie for now. If she calls back or you see her around the house or around the place where you work then you should call the police and also go to court and see about obtaining a restraining order.
