Just out of curiosity, what charges would those be?
I think you would have a hard time making a Forgery case (under Missouri Law) because you could not prove there was "purpose to defraud" by him signing his brother in early...
(at least, I would bet money that OUR prosecutors wouldn't even entertain it...)

Off the top of my head - Conspiracy (planning to commit crime in concert), Forgery (signing other's name with the intent to defraud), Fraud (defrauding the agency/city/county with respect to timekeeping/payroll), Burglary (entering structure with intent to commit theft, forgery/fraud, or other felony) - and there might be more, I'd have to actually sit down and go through codes... My particular department takes falsifying time records pretty seriously...

Even if you could prove intent to defraud (which I think would be tenuous in this case) there's no way our prosecutors would issue on that here.
Which doesn't make you wrong, it just illustrates the differences between localities and how stuff gets done.

For sure they would be Arrestable for the charges (which means at the very least, they would be booked in and spend half a day in jail and that's IF they bailed out later that night - otherwise they're there until court). Whether or not the DA would file, and exactly what they would file, would be YMMV. For sure, he would kiss his employment with that department and, most likely, every other department Bye Bye...
Hmmmm, my interpretation of the OP's plan was to have his brother substitute for him at the Academy. Someone smarter than me (cough ahem Citi ahem...) suggested that the OP might have been talking about his brother subbing for him with regards to checking in/registration for the Race. IF the latter is true, Then I apologize for the Red...
Personally, I think the Academy would have more heartburn over a student taking time to compete in Ironman due to the potential for injury during the event, which would wash that student out.

Its not worth it!!! Are you starting to see a pattern here? Every LEO here Feds, State, & Local has told you not to do it. You will have plenty of time after the Academy and FTO to compete in an Ironman. It's totally not worth the risk of getting hurt and fired just to compete in this Ironman.
It can't have been that much $$ and the exercise has been good for you to get ready for the academy.

Not to mention how anyone could get their homework done when they are "busy" from Friday dismissal until they get home Sunday (without any sleep).
Essentially this a recipe for disaster. If want to do it, do it and then apply next year. If you apply, you need to give 100% and that means sacrificng things, like doing an Ironman that year.

This reminds me of my academy. We had note cards to write questions on for the counselors and at the end of the day they would answer the questions in front of the whole class. Somebody during the first week submitted a note card requesting time off at the end of the month! That ended in a PT session from hell! We learned a valuable lesson that day, DON'T ASK QUESTIONS!
