In my state , the loser also pays additional supboena and court cost fees. Not to mention having to take off of woro to appear in court. The myth of the officer not showing up is just that. I have missed ONE court hearing in 24 1/2 years. The powers at be frown upon us missing them. ( this excludes being on duty and getting held up on a call of some sort). So please help put that old wives tale to rest.

Yes, in some cases , the judge can reduce the fine but not always. Better do your homework before you and she burn time off of work for a fixed fine with the prosecuting officers present.

As already mentioned, if the lady didn't jump the curb and dart out in front of your girlfriend's car, she's not going to have a case. The driver's responsibility doesn't start once the person has stepped off the curb. It begins when they see a pedestrian about to enter from the sidewalk. It's the driver's responsibility to anticipate someone is entering the crosswalk and take appropriate actions. If you are not braking until they are already on the crosswalk, then in many cases it's too late, and a ticket is probably warranted.

I haven't heard of anyone in my state having to pay court cost for fighting a ticket, but thanks for the heads up, I will have to check on that. I do realize that the chances of an officer not showing up are slim, especially because this officer does do TRAFFIC. That is her only job. So I am definitely not assuming that she won't be present because it would be stupid to do so. But hey, the way I look at it if we do go to court, we have a slim chance at winning, and if we don't we have a zero percent chance. But I am gonna look up if there is some additional cost.

Yea, well thats were the fact that there was an SUV parked right by the crosswalk that blocked the view of the sidewalk from the direction we were coming from. I have pictures of it, and if they took video than they will see it too. Thank you for taking some of your free time to answer my questions. Its appreciated
