    Question are arrests really mandatory

    I live in Oregon and I am wondering if arrests are mandatory for violations of protection orders. I would like to know if it is up to an officer's discretion after finding that the order has been violated to arrest the person that is violating the order. The type of protection order I am referring to is a stalking order that has been granted for unlimited duration. I would also like to know if stalking orders are only good for the county I live in, I thought they were good throughout the United States, however a Sgt. in my hometown did not feel that my stalking order was valid even though it was issued in this county.... until someone at the Sheriff's office explained to him that it is indeed valid. I would also like to know if it's a violation of the stalking order for the person to be restrained to call the protected person up and tell them that he is coming to town to blow them away... I was told that it is not a crime, even with my stalking order, as that person has a right to exercise their first amendment rights. I am confused and simply need some clarification regarding my questions and concerns with my protection order. I am hoping that I will not be the next woman to die because of police incompetence. Thank you.

    isn't there something with FAPA that states these violations call for a mandatory arrest? I am thankful that you responded, however, I thought that officers would answer this post. I suppose you are one, since this site said my que would be answered by an LEO. I am sorry you took offense to the user name I chose. I can assure you that I am not a hippy or a tree hugger, I am a single woman that just wants answers that are honest and real.

    would it be better if I changed my screen name to potential badge bunny? I came here for answers and I realize now that I have been given the same maltreatment from the officer that refused to act on the stalking I had to endure. I hope you do not work in my county and I feel sorry for the people you serve.

    It's valid everywhere in Oregon. It is a violation for the subject of the order to contact the person being protected and saying anything to them if it as no contact order. No contact means no contact. And I don't know any cop that would kiss it off other than the Sgt in your hometown who sounds like an idiot.

    The problem is, the police cannot be with you 24-7 to protect you. Use common sense, but call them if you are contacted. Also contact your attorney if you have one.

    Same here with the PFA. You must remember it is just a piece of paper, so if the stalker/abuser etc. doesn't pay any attention to it, he/she just may come after you.

    As far as mandatory arrests, it usually is a departmental thing. Some departments have mandatory arrests and some don't.

    Make sure you document every time he/she contacts you along with the threats made. Write it down, date, time, means of communication (phone, in person, cousin etc.) and contact the authorities.

    The problem is, the police cannot be with you 24-7 to protect you. Use common sense, but call them if you are contacted. Also contact your attorney if you have one.

    I find the screen name that you have chosen to be very......unusual for someone who is portraying themselves as a victim. But I guess it's better than badge bunny. Funny that someone like yourself knows that term already.

    Carry the Court Order with you at all times and KNOW what it says. If you are unsure of how it works , contact the court that issued it , the DA's office or some sort of Abused Womens Group / Shelter. They will know EXACTLY how they work and what you need to know about them.

    Well I have several suggestions for what you should make your screen name, but "badge bunny" wasn't one of them.

    I'm sorry if I trust the decisions made by deputies actually on scene for the calls over your opinions. If you received "maltreatment" from an officer on one of your calls, I'd almost bet it was a justified response for your behavior.

    It all depends on how your restraining order is written. I've literally seen dozens of varieties from absolutely zero contact, to simply no violence, and everything in between. So what conditions are on it makes all the difference.

    And here, yes it is a mandatory arrest if there is PC.

    Here's some further advice, record calls and keep texts. It is very, very hard to prove in court that the suspect was actually the person on the phone. Your word against his and a lot of times, the judge won't convict on just that.

    I have recently found out that the officer that handled the call regarding the violations of my stalking protective order has resigned from the police department. The officer that arrested me for the false allegations made by my stalker has also signed her resignation. The Sgt. that questioned the validity of the order is now working at the jail as he is no longer a part of the police department.
    I want to thank you for the kind words of encouragement that I have received regarding my original post.
