    Question for NYC Police: Pink Summons for an out-of-state resident

    On a recent vacation to new york, I received a pink violation for an open container of alcohol in a park. I was informed that I will need to appear in court, but the problem I face is that I live in California. I cannot take time off of work.

    I heard, but am still unclear if I can send a person to appear in my place. I do not plan on contesting the charges.

    How does an out-of-state resident properly address these charges and abide by the law without a trip to New York? Can I send a friend in my place with proof of my California residence an place ticket? What sort of paperwork should I provide? Any advice will be thankfully welcomed.

    I'm not from New York but I would imagine you can just plead guilty to it and pay a fine...you would have to contact the court with jurisdiction if the summons doesnt say it...

    NYC requires personal appearance in criminal court. Even for a guilty appearance. And if you no-show, they issue a wararnt for your arrest. Only you or a lawyer can appear, nobody else!

    What you got is much more than "just a ticket." You plead guilty and it will show on any criminal background check. Just like an arrest.

    Only way around this to:
    1) call the court clerk, explain, tell them you are in California and want to plead guilty and ask if they will waive your appearance; or
    2) You will have to hire a criminal lawyer in NYC to appear on your behalf with an affadavit at a cost of around $500-$600 plus the resulting fine.
