Having the dixie cup of booze in your car, whether or not it's considered against open container laws in your state, is probably a good indicator to the officer pulling you over that you've had something to drink from that container (and driving under the influence of alcohol is illegal in all 50 states). People don't generally poor some booze into a cup just to go for a drive, but many idiots decide (foolishly) to take their drink with them when they leave the party they've been drinking at.
So while it may well be against open container laws in your state, even if it isn't, it's going to be a nice red flag if you get pulled over that you may be DUI.

Every state I know of has a law, called Driving While Ability Impaired. That means your body has any alcohol in your system from .01 up to .079. The legislation was part of some federal DOT money several years back and I think most states have it. Under that law, (which I know is still active in NY/NJ) you can be arrested.
And why would anyone drink and drive?

Illegal in TN for driver to have an open container. Currently not illegal for passengers, but there may be city/town ordinances that prohibit it.
