    Unhappy Question about removing my Ex? He just won't go!

    I live in Texas and was divorced 4 years ago. He knew he had serious issues and let me have custody of our 3 children and the house. He then asked if he could stay until he found somewhere to live. I figured that I would let him stay awhile until he found a place. I didn't want him at the house, but the kids did. My children were young. Well the date came that the attorney had set for him to be out. He begged me for more time because he is disabled, is getting a small SSI check and had to find low income housing and fix his truck. I said okay, like a dummy. He kept saying that he had applied for housing, but they didn't have any available yet. So another year went by.....he would show me applications he was filling out, etc. I know now that he was bull sh*#ing me. He just wanted me to support him. He doesn't have a working car and uses my extra truck. Well, when I told him he couldn't use my truck anymore, I caught him, at 2 am trying to heat up a screw to put in the tire so I couldnt use it either. I am afraid he will do more damage to it. He gets very hateful and yells/cusses at me. I am tired of living like this. I sleep in a bunk bed in another room. I want my bed back. I also want my life back. I can't really date with him here. Who would want to date a idiot like me. uhhhh

    My question: for the past year or two I keep asking him to leave and he just flat refuses. He won't. Can I have the deputies (I live in country) make him get his stuff and get out?

    So I need to get another lawyer because this is a civil matter? I am a teacher so it is hard coming up with the money. I don't have extra spending money.

    Facts-house is is my name, bills all in my name, I refer to him as my Ex. I have my own checking account, etc.

    At this point, I suspect you will need to contact an attorney and get an eviction notice on him. The police can't really save you from bad life decisions without some kind of court action behind it.

    Calling the police when an ex shows up is one thing, letting him move in and take over your life and then call is something else, I'm afraid.

    Most likely the sheriff's office isn't going to get involved. If he basically admits to being a freeloader and not contributing to the household in any way whatsoever, then we could make him leave (at least in Florida). If there's a dispute as to whether or not he contributes to the household in any way...and this can be as minor as doing yard work or watching the kids...then it becomes a civil matter and you have to get him evicted. You can probably do this without the assistance of a lawyer, as it isn't a very difficult process.

    If there's a history of domestic violence and you're actually afraid of him, you can always go to the courthouse and apply for a protection order. If this is granted he'll have to leave the house (at least while the injunction is in force). But you didn't say that you're afraid of him for any reason, and for such an order to be granted you're going to need some proof.

    Thank you for your quick replies. I appreciate it a lot. To be honest, he has threatened with having me killed. He said he "knew" people. However, I think he is full of it. I am not afraid so I can't honestly use that. He has threatened my life a few times, but it is usually during heated arguements. I am ashamed how long I let him stay. I felt sorry for him. I don't anymore. I can now see he using me for a place to stay. I cook, mow, do gutters, clean pool, etc. I do everything, but he does do one thing, laundry. I can't say he watches the kids until I get home because he doesn't. Just a few days ago a neighbor boy was jumping from my roof into our pool. He jumped about 12 feet. My ex was inside asleep. Luckily the boy wasn't hurt. I just happened to see a video on facebook. grrrr

    I will try and see what documents I might file through the court to evict him and if I can't do that I will see an attorney. Maybe I can find a cheap one, yeah right. ha

    I never thought of getting an evicition order.

    Oh, if he won't leave when I get the eviction notice can deputies help show him the door?

    That's when most death threats occur. Use it.

    You're going to have to quit enabling start being tough if you want to get rid of him.

    Four years? I am sorry Mam, but there is a dynamic at work here that I don't and can't understand. If you REALLY want him gone then get the Eviction process started.

    In the mean time you need to look into WHY you continue to put up with this. Perhaps counseling?

    @ Roadkingwarrior Your right. It is weird and I can't even understand how it went so long. I can not stand him and it isn't pleasant being around him. I was a stupid sucker who felt guilty for trying to throw out a disabled loser. I do need counseling to see why I let him ruin my life for so long. The eviction process has been started.

    Some disabled people are simply enabled losers who would otherwise have a job if someone didn't coddle them. If his check is small, then more than likely his disability is as well. We all have to overcome adversity in some fashion, but some are forced to deal with it depending on their drive while others are happy to let Sam do it.
