    When Arresting? State of Texas.

    I have kind of a stupid question. None of this involves me; it’s all hypothetical. Say you initiate a traffic stop for speeding or just any traffic violation. What happens if you come across a driver w/o a DL or an exp. DL; or something that will allow you to arrest the driver. What do you do? Do you still issue the citations for everything & then put in custody? What is the proper process?

    In my state (not Texas) I can arrest for any traffic violation, but I rarely do it.

    When I do arrest someone for a traffic violation, the citations are written and issued at the station during the booking process.

    You can be arrested in Texas for any violation other than speeding and open container!

    You can arrest for either of those. Texas law states you cannot arrest for those IF the person signs a promise to appear.

    if the person refuses, he can be booked on those charges.

    To the OP; If a person is arrested he is not cited for the charge(s) arrested for. he can still be cited for anything he was not booked for.

    Here, we normally cite if you have no prior driving while suspended.
    If you have history of the violation, its a long ride to jail in the back seat.
    PS, the tow bill for your vehicle, will be almost as much as the ticket.
    On a clear night, I can see the other deputies emergency lights at least 10 miles away.
    But it isnt flat here LOL
