    Help me and my family find peace. Please.

    My name is carlos, in my family i have a 18 yr old brother who drives my mother insane. She has thyroid disease and cant really deal with any stress. Hes no longer a boy so he cant be kicked out that way. My mother is deciding to leave me and the family so she can be calm. I dont blame her, she needs him gone so that she could get better. I live in New York and im not that familiar with the law. I tried searching but found no way. Is there a way to get him out of the house? I love my mother and I want her to be healthy but my brother drives her insane by constantly asking for moeny and when he doesnt get what he ewants he starts punching the walls and screaming at everybody. My mother is force to give him the money she has so that no violence occurs in the house. My family lives on the poverty line but he does not care. Once again, he is 18 years old, he has no motivation to do anything, he dropped out of high school, does not have a GED, very violent and is also known to be on marijuana or alcoholic substances. I dont want him gone for a couple of days, I want him far away from my mother forever. Help me so that I can help my mother. This family holds no love for my brother and we are willing to do anything to get him out. I dont want my mother to suffer anymore, he does not listen to anyone and will not do what anyone tells him. Please help.

    I'm sorry, but there is nothing the police can do. Your mother can tell him to leave, but it doesn't sound like she is able.

    Does your mother have any kind of caseworker?

    No, she doesnt. And telling him to leave wont do anything. Is there anyway to do something by taking him to court?

    I am wondering if a case could be made for CDV in NY, what with the wall punching and threatened violence.

    I am retired and laws are different in each state, so a NY Cop would really need to comment.

    In my state, Law Enforcement might also refer you/her to a Magistrate to get an eviction order, as well. 17 YOA is an adult here.

    He never hit anyone in my family. He only hits the walls and the furniture. My mother has to give him what he asks for because she does not want my dad to get involved andcause violence. My dad is not a violent man, but my brother provokes him alot. So my mom is forced to give him what he asks for. But all this stress is making her very unhealthy.

    Hes 18, he can call the cops if my dad touches him. I need a way to do it with the law.

    Not knowing New York..

    Here in Florida the two options would be to due to the domestic nature of the problem, threats of violence, and damaging property would be to see if a judge could grant and injunction for protection (restraining order) which would immediately remove him from the residence. If not, he can always be evicted by going to court and getting an eviction order signed by a judge.

    In pennsylvania , the threat of violence or the fact that one lives in fear of being assaulted is enough to get a protection order to legally kick him out.

    But....your parents must agree to do this. No wishy washy caving in or they are stuck with him for life.

    Have you spoken to a police officer in your area ?

    I havent, but I took the ideas you guys gave me and ima see what I can do. I will speak to a officer nearby. Thanks for everyone who commented.
