New York tint laws. Texas resident.

I am currently attending college in New York where the tint law is 70%. I am a resident in Texas where the tint laws are 25%. The car is registered in TX and my only drivers license is a Texas DL. Can I get a ticket in NY for the tint? Thanks.

Yes, you absolutely can get ticketed.

You're not the first person to try to skirt laws by claiming residence in another state, so most states have enacted laws to close loopholes like that.

When you move there, even if it's not permanent, you must comply with traffic laws of New York. You must comply with the registration laws, the driver's licensing laws, the insurance laws, the vehicle equipment laws (including display of plates and window tint.)

Actually in NY you CAN NOT get a ticket. NY tint law is a "non-DOT equipment violation" for NY registered vehicles only. Since you are not a resident, as long as you have your Texas license, Texas registration and can prove you are not a full time resident (going home for summers), your vehicle (just like FL cars), are not subject to ANY non-DOT equipment violations (muffler volume and tint).

If a cop issues the ticket, don't argue in the street. Head to court and plead "Not guilty on grounds of a non-DOT equipment violation on a non-resident vehicle." The judge will automatically dismiss such in NY State.

As long as you are not a resident of the state (college kids in for school are not considered residents), you DO have to comply with the rules of the road, and as long as your car maintains a valid registration/insurance/inspection from your home state, you are not subject to NY rules for such. However, any safety item is required to be maintained by national standards (DOT), whihc have been adopted by all 50 states. Meaning you can't have red headlights....they must be white and working...wipers must work....turn signals...brakes, etc....

NY and NJ are actually reasonable and logical states. Nobody here expects a college kid or person visiting from Florida to have the tint removed during their stay.
-In God we trust. All others, put your hands on the car and don't move.

    Oops. Okay, my bad.

My state doesn't differentiate between student/non-student.
