    1 more question to throw out there. What would be my best plan for if he has property in the truck? Should I take it out an leave it there, take it home and box it up then take it back,send it back, or leave it until he calls?

    In NY, if the car has your name on the title, your name on the registration, your name on the insurance and your name on the financing with the bank who has a lien, you could go repo the truck yourself. You would be able to take the truck at any time. You are required to stop at the police station and inform them of what you did and show proof you own the vehcile (via a copy of the title, copy of the agreement you two have and a copy/letter from the finance company showing a loan in your name with late or missing payments). You are then obligtated in NY to sent a certified letetr with return card to him stating you have his property and when and how he can pick it up.

    I suggest getting a copy of the key made if you don't have one at the dealer. They will make you one if you have a copy of the title and mathcing ID.

    Once you get the truck back, keep in mind he has a key, so you may have to spend a few bucks and get the car re-keyed so he does not steal it back.

    Yes that's exactly what i wanted to hear. All of those parts are in my name think the insurance is in both of ours but not to sure need to look into that. Ok well thank you for all the help again. That will be a big help, and yeah i figured i would contact the cops and let them know i was going to take it back just in case he tried to report it stolen.

    Easiest thing to do is just don't make any more payments...Finance company repossesses the truck, you don't have to do anything except catch the payments up when contacted by the finance company.

    Problem solved.

    Already asked them about that. They say it will be a marc for the repo on my credit, ill have to pay back fees asap, pay the tow truck and impound fees as well. Think i am just going to go take back the truck this weekend his problem not mine. Thanks again for all the help

    If you are going to take it yourself.....call the police as SOON as you are driving it away and tell them that you are the legal owner and that you repo'd it from him. Give them your contact info in case they need to call you back when he tries to make an auto theft report.
