Call your bank immediately. Advise them of the unauthorized charge.
They will cancel your current card and reissue a new one. They will most likely agree
to delete the charge from your account.
Keep closer watch on how and where you use your card.
No, your bank cannot throw anyone in jail.
Notify the Police in the town where the purchase was made. If they investigate, they will be able to obtain a copy of the video of who purchased the item - if the store videos their sales. Also, as you have been informed, contact your credit card company and report the theft and unlawful use.

Banks are private companies, with no arrest authority or ability to put people in jail. That's why God created police officers. If you suspect your card has been used fraudulently, the smart person would make two phone calls: one to the bank to report the suspected fraudulent transaction (so that hopefully you're not held financially responsible for the purchase), and another to the police to report a suspected crime (so that the bad guys can hopefully go to jail).

why r u speechless? lol also would it be too late since the incident happened in november and i already cancelled that card in november? there was another charge in november i got credit for but i had overlooked this one. I just have a suspect I didnt actually see him use my card i just have a suspician.

Look on the back of your credit card and call that number. Ask for the fraud dept.
I buy everything on a credit card and pay it all off at the end of the month so I download my charges everyday. A few years ago, I saw a charge to a Honda dealer in S.F. for 600 bucks. I called the credit card company and they immediately froze the account and sent me a new one with a new number.
I got a call from them a few days later and their person in fraud asked me if I had a daughter down there. I told her I didn't and she said the person making the charge identified herself as such. They sent me an affidavit to sign and they pressed charges down there. Since they took the charge off my account and they were the victim, they handled everything with the police.
I still have no idea how they got my credit card number unless some person where I used it kept the number. Although the customer's receipt has most of the number X'd out, the merchant copy has all the info on it. If the person looked at the code number on the back and memorized it, they have all they need. Now I scratch off that code and just remember it whenever I get a new card issued.

If the person purchased an Xbox Live subscription, they shouldn't be too hard to track down. It's also one of the easiest reports for a patrol officer to bang out.
