Speeding ticket with wrong statue number

Last Tuesday I received my first speeding ticket. Underneath the "traffic offenses" section on the ticket speeding is checked off followed by how fast I was going in what MPH zone. However, underneath in the statue number section, the police officer wrote 39:4-50. This is the code for driving while under the influence. When I look my ticket up online, the same code comes up. I have to call to see if I can get my ticket rescheduled because I will be away on the date of my court appearance, should I also bring this error up or leave it as is?

You are in NJ so I can help you out. The cop might have done you a HUGE favor. What court is the summons returnable to and what agency wrote it. It matters..... Then I can tell you if you are lucky.

Well, were you drinking prior to being stopped? Were you under the influence of an alcoholic beverage and/or drugs? Even though you are speeding doesn't mean you weren't under the influence of alcohol or drugs.

Heh, people here definitely know if they were charged with DUI.....

Also, the courts will toss any ticket if the police make a mistake of any significance at all. On major ones, the court may tell us to reissue, but mostly they use it as a training aid so we don't screw up again.

While all we can do is speculate as to what the judge will do, I'm more inclined to believe that he/she will permit the officer to amend the statute number once you appear in court, or re-issue a new citation.

In all honesty, if the judge were to dismiss the ticket, it would be a poor decision for a simple mistake that can easily be corrected.

In the end, it boils down to this: were you speeding?

I've made a mistake on citation before (amazing I know, but I am human) and when it came to court I just advised the judge that I wished to amend the incorrect portion and the trial continued with the new/correct violation.
