    MIP at age 17 in Oregon

    So I was being stupid, and **** went down and I got an MIP. Like I said, I'm 17 and I live in Oregon. This is the first offense. The main thing I'm worried about is the license suspension. From what I've read, there is the potential for them to suspend my license for a year. This seems a bit ridiculous, but that's another deal. How likely is it that they will actually suspend it? And is there anything I can do, classes I can take to avoid this? Also, I don't know if it counts for anything, but the cops did NOT receive permission to enter either the house that the party was at, or my house when he brought me home. Also, on the way to my house the cop was going 60 in a 35 zone, no lights or anything. When I asked him about it, he said in not so few words that he was above the speed limit. Are either of these things going to help my case, or do they not matter?

    The other thing I'm worried about is I'm currently in the Delayed Entry Program for the Navy. An MIP could get me kicked out. Is there a chance of doing community service or anything to get the charge dropped or something? I'm just hoping for a miracle, thanks.

    1.) You don't need advice from a cop, you need advice from a lawyer. No one here is going to second guess what those officers did based on your side of the story only.

    1.5) Don't swear on the board, it's against the TOS.

    2.) There are plenty of circumstances in which police officers can enter a residence without permission.

    3.) You were outside with a RADAR gun in order to get his exact speed? You've had training in visual estimation of vehicle speed? If not, then you are just guessing, and if you were drinking that night, I'm pretty sure your guess is less than accurate.

    4.) I often go over the speed limit in order to get to a call for service. It won't help your case (or have any effect on it at all) but you can file a complaint if you want to with the department if you feel the officer was driving unsafely.

    5.) Having an MIP mess up your chances in the Navy would have been a good thing to think about prior to getting into a circumstance where an MIP was a possibility.

    None of the things you listed will really help your case, IMHO. If you want to fight it based on an alleged illegal entry by the officers, feel free to do so, but I would not be optimistic about those chances.

    I apologize for the swearing. And I will seek legal advice from a lawyer, but this is what I have available at this exact moment, so I'm looking into all avenues. And I know he was going 60 because I was in the car and I was staring at the speedometer.

    Oregon has cracked down on minors' driving privileges and it's easier to suspend them now. Traffic deaths caused by teenagers have also dropped significantly so there is a reason for it. They've changed all that since I retired, so I'm not sure what the laws are. You can Google ORS traffic laws as easy as we can.

    It probably will not effect your entry into the Navy. If you are 17, it will handled at the juvenile court level and that's not a huge deal in Oregon. Juvenile court referees are pretty lenient IF this is a first offense.

    If the police were speeding to get there, I suspect there was a reason for it. If there were a bunch of kids in a house drinking illegally, they probably had probable cause to enter. You were breaking the law, not them.

    The bottom line is, yes you did a stupid thing and now you must suffer the consequences of it. That's what's life's about.

    Learn your lesson, take your lumps and good luck with the rest of your life.

    Okay, let me get this straight! You messed up and got caught with alcohol as a minor. Now, you are seeking retribution for your sins by blaming the police - unlawful entry, speeding, etc. Clue to OP: NO! None of your inane allegations will result in having the case dismissed. You did not attempt to stop the officers from entering your home. They responded to a call for service where they happened to observe you and others in possession of an alcoholic beverage and they took action for the observed violations.

    The officer may drive at any speed he so desires as long as he is within the law of the State of Oregon with respect to speed. Just because a sign says 35 it does not mean you cannot go faster if it is within the safe and prudent limit and endangers no others.

    What the officer does after you err, has nothing to do with YOUR incident.

    I would suggest you explain your situation to the hearing officer. Perhaps, just perhaps, he will see the benefits of your entering the military and will help to expedite the process. And, in that regard, if you are going into the Navy, you won't need a driver's license for a while. If you get my meaning?

    The judge at one of the areas I work will often start a hearing with something along the lines of "Please understand I do not supervise the police, and any problem you may have must be addressed with their department not at this hearing." I like that.

    The speeding issue is definitely not something that affects the case in any way.
