Am I immune to being charged with a crime in my county?

A guy I know is running for District Attorney of the county in which I reside. He is a respected law professor whom is running unopposed. When an arrest is made, or when an individual wants to press charges, the decision of whether or not to pursue charges is in the DA's hands.

The way I know him is that we are both regulars at the same cigar lounge. I have been to a few parties at his house. So, I know him well enough that he won't want to pursue charges against me, but at the same time, the fact that we know each other is not really common knowledge, so no one would know he's showing favoritism.

He's already told me, just don't do anything horrific, or frequent.

So, if I do something minor, like simple assault, or underage drinking, (I'm 20) am I home free?

Oh, and while many prosecuting decisions are made by Assistant DAs, the lead DA always knows of the cases and decisions going on in his office, and he can override his staff's decision on whether a given case is a go or no go.

And again, he's already said, just don't do anything horrific, don't make a habbit getting arrested frequently and don't do anything that would make the headlines. He will take office this May, so if I'm right here, am I in for a hell of a summer?

No, you are not.

You can be charged Federally still, and in my county, you could be charged in municipal court (in my city) and the county DA would have no say at all. You are presuming a lot here; he isn't going to really risk his career over some stupid criminal act you commit.

And you are not immune to even the felony charges on the state level. The only thing that you will do is bring him down on some felony charges with you. Officers tend to get cranky when they do paperwork and invest themselves in an arrest on someone like you, and with the attitude you are already copping, I can see it becoming personal for the officer quite quickly. Also, victims don't tend to just let things go. There are media outlets and checks and balances. No one can write you a hall pass.

I invite you to try. Tell us how it works out after your incarceration has expired. Now go away.

It won't be too hard to make some phone calls to Hawaii and find out what law professor is running, unopposed, for the District Attorneys job. I bet your cigar smoking buddy would freak the hell out if he read your post. I also bet the State Attorney would be interested, as well as the local media that you are bragging about an unethical relationship with a potential DA. They won’t care too much about your young butt…guess who will catch the heat?
