    accidental murder/stabbing(not sure what i should put)

    okay the other day, i had just taken my dog outside(shes on a leash thats bolted to the ground, a 25 foot leash) and i came back outside, and i came back in.

    about 3 minutes earlier it sounded like someone was messing with stuff outside my house, so i grabbed my spear that i made(took a broom handle and tied a 9 inch bladed knife on the end of it) to scare who was ever out there off our property(wasn't going to stab them, was meant to just scare them) but no one was out there, so i turn around and go to walk back to my house and i get on my porch, and my mom was right outside the door and i thrusted the spear, but luckily i noticed that it was my mom and i came probably about 6 inches away from her stomach. i was so scared for my moms life, but i was trying to protect her because i thought someone was fixing to go into my house, and my mom just had surgery so there was no way she could of defended herself.

    my question is, if i accidentally stabbed her and killed/hurt her badly, and had to call 911. would that be considered accidental murder?

    (u can send cops to my house lol, my mom is indeed alive, im just wondering if i would of went to prison for that if i did on accident.)

    An accident can be an accident and by definition, not intentional. But if it's caused by reckless behavior, it becomes criminal.

    Stupidity, as in this case would not be a viable defense.

    Be glad it was a make-shift spear and not a gun you had. If you spook as easily as you decribed, it would be very likely you would have shot and killed your own mother.

    Anyway, depending on the circumstances, you could have been charged with manslaughter if you had killed your mother...along with anything else that applied to the situation.

    An action often becomes criminal based on four different elements:

    1. Intentionally.
    2. Knowingly.
    3. Recklessly.
    4. Negligently.

    Those are mental states of "culpability", and your behavior in such an instance as you described it would fit. So, if by chance you're asking us this because you're thinking there may be a chance you may, oops, do something like this, I'd tell you to research correctional facilities for dummies. If you're asking because this really happened, then I'd tell you to attend some sort of self-defense class and learn how to become "tactically aware".

    Sparky, my advice to you would be to toss the spear. And I mean into a fire, not at another family member or small woodland creature.

    I bet it would make your mom feel really warm and fuzzy inside knowing that you would be more concerned over what you could be charged with should you "accidentally" thrust a spear into her stomach than the fact that you just f'ing stabbed your mom with a spear and killed her.

    I'm just glad that we are all here to help you plan the ins and outs of your little murder plot. Quit playing Clue and get some therapy.
