    reality regarding my Vehicular Manslaughter question

    My interest in this Vehicular manslaughter misd. vs. felony senario is ........I am the mother of the driver that was killed! My 19 yr old daughter lost her life in this accident! Now for the whole story...........Not only did the other driver not have a valid DL, no insurance, run a red light with the B.A. 0.1...............HE WAS AN ILLEGAL IN OUR COUNTRY! The state of Nevada dropped his charges to a Misd. so he never was charged and INS stepped in and deported him.!!!! I am riddled with PAIN over this! I feel they just swept my daughters life and death under the carpet! The D.A. felt real proud of themselves assurring me that they are leaving the case open and he now has a Misd. Bench warrant for Vehicular manslaughter if he comes back across the boarder. The last words the D.A. left me with was..."they suggested that i seek grievance counseling so that i can move on in my life!!!" I know in my heart if this was the D.A.'s daughter or the daughter of one of the INS people this man would have been charged with FELONY Vehicular manslaughter! Because I am just a law abiding , single mom with no political pull (and a US citizen)my baby girl's life meant nothing! Well you know what???? She meant EVERTHING TO ME!
    NOW....HERE IS THE ICING ON THE CAKE! This accident happened 4 yrs ago. Prior to the death of my daughter my 20 yr son suffered a massive brain anurisym followed by a stroke! By the grace of God he survived but is now handicapp. Exactly 1 yr and 12 days after my sons accident my daughter was killed. Needless to say the last 4 yrs I have been struggling just to wake up each day and keep one foot in front of the other and figure out my purpose in life! I came to the decision the only way to seek some sort of closure and try to move on in my life, I needed to make an appt with the D.A.'s office and request to sit down face to face with the D.A. assigned to this case in hopes they could explain to me ....how and why this got dropped to a misd. and he was not helded accountable for the death of my daughter? On Jan 7th of this year, I personally went to the D.A.s office...explained i was just trying to get closure and in order to do so i just truly needed a face to face conversation with the D.A. It was not something i didn't want to handle via a phone call and as the mother i felt i had that much respect coming to me.I was speaking to the D.A.'s head of Records. She totally agreed and said she would personally give the D.A my message. I reitterated to her ," I realize there is no bringing my daughter back, nor will this guy ever be prosecuted. What i do need is clarifacation of this law and help in understanding it. Since Jan 7th -to date the D.A has never returned a call to me. I have waited till the end of each work day in hope for a return call to no avail. So everyday at 4:45 pm i have called... left voicemail and also spoke with 3 D.A secretary's requesting an appt. or a return call from the D.A. The only response i have recieved was from 2 victims advocates to tell me its an open case with a misd. bench warrant. They can not clarify the law to me and they tell me they will personally leave the message for the D.A. to call me. I have been to the washoe County Law Library, Washoe Legal Services, spoke with a marshall at the court house who advised me to go to the City Attorney's office and or the Mayor's office just to get clarification on the Law! Ironically they cant give me an answer and say I'm sorry we cant help you. It amazes me that so many people in power of the law and supposedly are to enforce our laws...can not explain it to me and just dont know the answer.
    I truely want to thank those officers that have taken the time to answer my simple request for verification of the vehicular manslaughter law. It sickens me to my core in knowing that he was in our country illegally, disrespected the law that we as citizens are expected to abide by and killed my babygirl and no body careds. Becuz It was Not Their Child! I guess to much paperwork invoved and just easier to send him home so he has to get another alias and can work on sneaking back across the border. I welcome any and all comments, suggestions or direction to this post. I refuse to allow the D.A. to just blow me off and ignore my request to meet. I want him to look me in the eyes and tell me that he sought justice for the crime of killing my daughter and tell me to that he upheld the law.

    Losing a child is horrible. My wife lost her son 9 years ago in a car wreck. He would have been 30 yesterday.

    And no, you can't move on with your life. It doesn't work that way. It leaves a hole in your heart that will never heal.

    But I can say that what happens to that person will not change anything. Grieve for the loss of your daughter. I know that it seems as though a prosecution would bring closure, but it won't. My wife struggled with that for several years until she realized that nothing would really change anything.

    I am so sorry for your loss.

    Look for a local chapter of The Compassionate Friends. It's an organization of people who have lost children. Everyone there knows exactly how you feel and can honestly give you some support.
