    Indiana DWLS / Driving While Revoked in the state of IL

    I am in a tricky situation here. Come March it will have been three years since I was suspended for a second DUI. I received a three year suspension for failure to take the BAC, this happened in Illinois. I also got a DWLS (before I was technically revoked I suppose) which doubled that 3 years to 6 years in the state of Illinois. I am being told flat out in Illinois I have no choice but to wait an addition 3 years and that an out of state hearing will do me no good.

    That being said - I now live in Indiana. I read here a while abck that it is a slap on the wrist for DWLS but this gentleman was just temporarily suspended for failure to pay fees whereas I am terminally suspended / revoked.

    A few questions :

    1) Will I be charged with Driving Without a License or Driving on a Revoked License if I am caught operating a motor vehicle ?

    2) What types of fines / penalties / jail time would I be looking at if I was to be caught ?

    3) Does anyone know if this would be reported back to IL as well which would add an additional 3 years to my suspension there.

    I am trying everything I possibly can to get out of this hole I have dug myself in but honestly I am talking 4 1/2 hours every day on the bus to get to work and back. I am unable to attend AA meetings due to the lack of my license. I really don't want to dig myself in a deeper hole here but I really need to live my life. I do understand it is a priviledge not a right. That being said after three years of being without a license (2.8 of them I haven't driven) and in a town such as Indy with pathetic mass transit and being so far spread out - I am at my wit's end. Very very open to suggestions on how to get my license back legally and WILL abide by ANY court order.

    Contact your local Indiana DMV/BMV and ask them what your option are.

    I have been told flat out I have absolutely no options. My only option would be to move to Colorado where Colorado state law would apply and I would of become eligible for reinstatement after 21-24 months which has since passed.

    However, I can't very well move to Colorado when my job and life is here now ... It is also thousands of miles away from my daughter. To add insult to injury, even if I was to do so I would still be revoked in the state of IL (only allowed to legally drive in the other 49 states) which is where my daughter lives. This is not a kill all, but I don't want to have to lie about living in CO unless necessary. Not to mention an extreme amount of expenses traveling there and back for the multi part reinstatement hearing process.

    Thank You though for not casing on my ill chosen thoughts of driving in this situation.

    You should not be allowed to operate any vehicle weighing more than 26lbs, ever. That being said, your questions have been answered, yo. Have a great day.

    Signal, I understand your thought process. I really do.

    You are sort of rubbing salt in the wound though. I would assume that mutual respect is expected on this board not just by non police officers towards police officers. I have shown you, this board, and all other people involved the type of courtesy that you expect. Is it too much to ask you not to rub my face in the poor decisions I have made in the past ?

    If you asked me to do a year in jail to get my driver license back - I would gladly do so and accept responsibility for my actions. I fully understand I have messed up, however I am unfortunately past that point and there is nothing I can do but correct my current situation and try to live my future life as best as possible.

    Please do not belittle me because of past mistakes I made. I try not to live in the past every day of my life and would hope that out of all people in the world police officers or anyone involved in law enforcement would praise someone who is TRYING to reform their past mistakes instead of ending up in the system.

    Yes, it is too much to ask. Having been to too many fatal DWI accidents, where an innocent person was the fatality and the person who made a "mistake" walks (stumbles) away; and having a lifelong friend and father of two be killed by a DWI driver (on a suspension for a prior DWI), I don't think it is harsh, or disrespectful.

    Reform? You had that opportunity after the first DWI.

    The facts are, you received your second DWI and are serving the consequences for the choices you have made, not mistakes. Now, you come here and ask seemingly innocent questions, yet assert your willingness to scoot those same consequences and hint at getting a CO license in an attempt to slide around your punishment.

    Out of respect I will not post what I want to signal.

    That being said had I simply blown in the breathlyser I would be a year past my punishment. However I was under a new medication called Ambien prescribed by my doctor and do NOT remember so much as getting behind the wheel that night. I woke up in County lockup facing these consequences with the arresting officer stating at my Judiciary Hearing he didn't understand why I refused the breathlyser when he did not smell alcohol and no blood testing was requested.

    Not everything is always as clear ... or cut and dry as people think it is. And no .. my questions weren't answered actually, one was .. That was it.

    As far as going to CO - I have stated I dont want to do this but it is however not 'skirting around my punishiment' in anyway. It is 100% legal and still stops me from visiting my daughter if that makes you happy.

    I didn't kill anyone in my DUI where I was actually intoxicated. It was a wake up call, and if you know anything about Ambien you will know I am not the first person something similar to this has happened to under this medication which was prescribed and taken as prescribed.

    You are not supposed to operate a MV under Ambien either, and said medication warns you of same. It is still Driving While Impaired, even under medication.

    1 - if in another state, you will probably be charged with having no license to drive. In IL, it will be driving suspended.

    2- Contact DMV and the Courts. Each state is different.

    3- If the state you are cited in is a reciprocal state, IL will be notified. Contact IL DMV for a list of reciprocal states.

    I have NO recollection of getting behind the wheel .. PERIOD !

    I took the medicine, was sitting at my computer desk, and the next thing I knew I woke up in County Jail.

    I did not take the medicine and pop behind the wheel for a drive - I took the medicine at home with the full intentions of going to sleep. This medicine causes sleep walking and has an extremely high number of case studies where the person has done things the night before and did not remember them at all. From sexual encounters to driving motor vehicles. People have woken up on foot miles from their home and not aware of what happened because of this medication - Feel free to research it yourself. I have no reason to lie .. and I have accepted responsibility for both my actions and my decisions (even though some actions I honestly had no control over as cliche as that sounds!)

    TY Signal for asking - I have tried contacting both but it is a serious run around here in Indy and after two days on the phone I gave up hoping to find an Indianapolis Police Officer here. I will keep trying to do my research through the proper channels and appreciate you taking the time to respond.

    Then your attorney should have argued that at your second DUI trial. Rehashing it here does not change your conviction(s).

    I'm not sure what you expect of the police, specifically the police HERE on this site. We do not make the laws, we are not in charge of the department of motor vehicles, and we don't have anything to do with what information one state reports to another. You are being given information on the things we DO know about, namely enforcement. That is what the answers will concentrate on because that is what we are about. So, to answer your questions:

    Yes.

    This depends on the locality in which you were stopped

    3) Does anyone know if this would be reported back to IL as well which would add an additional 3 years to my suspension there.

    This is also location dependent, but with the ease of information sharing in the digital age, I would not be surprised.

    Go Directly .. I have no problems with posts like your post. I just don't see the reason it was necessary to try to belittle me when I came here for information - very well aware of the poor choices I made in my life, believe me.

    The only reason my attorney did not argue that at my DUI hearing is in IL the state law gives you a statutory summary suspension that is separate from your DUI conviction and penalties. All I faced for the 2nd DUI conviction was 1 year revocation - I already had 3 years of court supervision by loosing the summary suspension hearing - there was little that could be done to benefit me by winning the DUI trial and it would of cost thousands of dollars.

    As far as CO goes - I would establish a business in the state of Colorado, pay taxes, and operate a Colorado state business if I go that route. That is the other legal way to get licensed there in lieu of residency. Again, I do not want to go this route though. I would like to be able to clear up these issues .. But, that seems impossible at this point.

    I just got off the phone with my Uncle, a practical thinker and he suggested I move to the center of Indianapolis by an AA group which would cut my transit time in half (to 2.5 hours TOTAL bus transit to work or AA meetings) - it would just cost me $8,000 for violating my lease agreement. This is the most logical choice for me at this point I hate to say.
