    Misplaced my license, illegal to drive?

    I am a licensed California driver but I misplaced the card. If I drive anyway and get pulled over for doing something minor like speeding, would YOU write me a ticket for not having my license in addition to whatever else I did if I had my passport with me so I could at least prove my identity? I have a ticket for underage possession of alcohol on my record that I plan to take a class for, as well as one speeding ticket, would that affect your decision?

    Yes. A passport doesn't give you permission to drive.

    No, your previous alcohol charge would not affect my decision, and were I in a position to: yes, despite the Passport to prove identity, I would write you for not being in possession of a driver's license.

    Take a bus, ride a bike or get someone to drive you to DMV. It's not hard to get a replacement.

    In NYS we can summones you for "Fail to Produce" rather than Unlicensed. So, even if a computer (MDT) check says you have a license you can still get one.

    Possession of License

    12951. (a) The licensee shall have the valid driver's license issued to him or her in his or her immediate possession at all times when driving a motor vehicle upon a highway.

    Any charge under this subdivision shall be dismissed when the person charged produces in court a driver's license duly issued to that person and valid at the time of his or her arrest, except that upon a third or subsequent charge the court in its discretion may dismiss the charge. When a temporary, interim, or duplicate driver's license is produced in court, the charge shall not be dismissed unless the court has been furnished proof by the Department of Motor Vehicles that the temporary, interim, or duplicate license was issued prior to the arrest, that the driving privilege and license had not been suspended or revoked, and that the person was eligible for the temporary, interim, or duplicate license.

    (b) The driver of a motor vehicle shall present his or her license for examination upon demand of a peace officer enforcing the provisions of this code.

    Amended Ch. 1292, Stats. 1993. Effective January 1, 1994.
    There are no exemptions that allow one to drive a motor vehicle without having the license in your possession.

    While you CAN be written a ticket for not having your license in possession, it's entirely up to the discretion of the officer.

    LOL, I remember stopping a guy and after asking for his license, receiving a photocopy of it.

    When I asked where his license was he replied he kept it safe at home and decided to use photocopies.

    Kind of off topic but we get a lot of people who do this with their Immigration Documents. Even though the law clearly states that all legal aliens MUST carry their Immigration documents with them AT ALL TIMES They are afraid they might loose them or even worse someone (mostly school admin) tells them it's OK to just carry photocopies.

    Slowly the federal citations are being given to USBP (its now mostly on the northern border) so not only do they go thru several hours of he!! while their status is verified they will receive a $500 citation the MUST be paid if they ever wish to renew or change their status.

    Illegal in TN (as with most other states I assume) to drive without your license on person, even if we can verify by conducting a DMV check through dispatch. Technically in TN they recommend to book the person to verify identity.
