    Adolescent Restraint Procedure NY

    I was told an adolescent was in the ER and released. The Social Worker told me an officer punched the said adolescent in the eye. I'm not a lawyer, first of all. I'm a nurse inquirying about the amount of restraint allowed. I am not aware of what the adolescent was doing and am not aware of any weapons that he carried if any at all. I've worked with troubled youth but was under the impression that there is a limit to restraint which doesn't include a punch to the face. Thanks for your enlightenment here in NY!

    Your impression is incorrect. Anything up to and including lethal force is authorized depending on the circumstances. Since NONE of us here knows the circumstances (including you) you'll never find out here on the interwebz why it happened.

    You're welcome to pack up and go home. Go down the street to a police station and ask them there - in person. On the internet, you don't get to pick and choose who responds and at what time.

    Use of force is pretty standard across the board. There isn't any "special dispensation" because the cops are in NYC.

    In NY the use of force is guided by the law, and department guidelines. The law does not make a distinction based on age of the perp, and department guidelines are internal department documents, not for the public.

    How old was this kid? NYS Penal law makes someone who commits a crime an adult at 16, and for some serious felonies, as young as 13, as a juvenile offender.

    And BTW the uses of force don't differ much from state to state, so force in Arizona is pretty much the same as force in NY, and the other 48 states, and DC.
