    Silly?Maybe

    Hello, I have 2 questions for you folks. First why did police go from carrying 9 mm to carrying .40? I think I read that right. That is kind of scary I think.

    Secondly, do city police have jurdiscation over Armed Forces personal? If so can they be arrested? If not and they break the law who handles it? The MP's or someone else? Just curious. Thanks

    .40 makes bigger holes. Threats are stopped quicker with fewer shots fired... at least, that's the theory.

    Why is that scary?

    Yes, they can. If a military member breaks civilian law, he can certainly be arrested. A courtesy call would likely be made to that individuals command, and different circumstances can be handled in different ways.

    Don't know why that would be scary. I have a .45 within 3 feet of me right now, plus I've shot MUCH larger rounds in the Marines. The M2 machine gun shoots .50 caliber rounds and the Mk19 is a fully-automatic 40mm grenade launcher. Then, there was the AT-4....God, I wished I had a live target.

    Not for violations of the UCMJ. However, if the military issues a warrant, city/state/local/federal cops can pick up the military member for that warrant. But, if they violate city/state/local/federal laws outside a military installation, they're ours.

    Why would you think they would be immune? They aren't diplomats. If you're in the Army and get into trouble off post in a foreign country, you'll find out real quick about all that....

    On minor stuff, (drunk in public, etc.) we'll usually contact the local commanders, but if it's a serious crime, they go to jail and face all the same consequences that a civilian would. The only thing the Army will do is possibly bust your chops again when you get out.

    Isn't that called "Double Jeopardy"? You say, "possibly bust their chops." I was under the impression that they did get punishment for getting into trouble while off post. Just asking. Be Safe.

    If I remember correctly, double jeopardy wouldn't apply because the military will find a way to punish you for a different crime against the UCMJ. For instance, you are in the military & you get arrested on the civilian side and spend a bunch of time in jail, you would be Unauthorized Absence (UA) from your place of duty in the military. That's what they would get you on. Oh, and that pesky Conduct Unbecoming Article (for officers) and the General Article (for all who are answerable to the UCMJ) are good catch-all articles they could "bust your chops" on.

    Basically, it's a loophole around double jeopardy that allows them to effectively punish you a second time for your crime.

    When you were a kid and got in trouble at school, didn't your parents also discipline you? Was that double jeopardy? Look at it this way: you err in my jurisdiction and I prosecute you; then, I notify your daddy - the USMC. If he choses to punish you, so be it. He has the right.

    You see, if you commit a violation off base you violate the state law. That act is also a violation of the UCMJ. The UCMJ says you cannot violate a law off base, so that is a separate charge and you get hammered. No double jeopardy!

    While the UCMJ has lots of prohibited acts that are similar to civilian statutes, they normally wouldn't be charged again for the same crime in the military system. Aside from that, they're also two different systems. Akin to criminal and civil court where you can be tried in both courts for the same violation. The remedies are different, hence there's no double jeopardy.

    a) NYPD still carries 9mm. I'm not going to get involved in a debate about firearms/stopping power/use of force.

    b) maybe. If someone breaks a law within my jurisdiction, they can be arrested by me, even if they're a private, or a 4 star general, with the exception of other uniformed members of my department, and individuals from foreign countries with diplomatic immunity.

    Sometimes bigger is better! . I was able to get hands on a Sig Sauer .45 when TX DPS went to the .357 Sig. It actually kicks less than the .357. Be Safe.
