    Fight tint ticket

    I was recently pulled over for a tint ticket. The officer said my tint looks too dark, ran the meter, and never told me the output. I told him I bought my car this way. The officer asked for my license and went back to his car. He came back with a ticket, and said it's a non moving violation and I have to take care of it.

    I looked at the ticket, and it lists:

    TINT TOO DARK

    And under the comments at the bottom of the ticket it lists:

    TINT70PERCENT

    In my state, the legal tint is 50%. According to this ticket, I'm actually over the legal limit. My understanding was, the higher the %, the lighter the tint.

    Is this something worth bringing up to the court, that I was ticketed for 70% which by the standard tint percentage, is beyond legal in my state?

    I believe you have it backwards. 70% tint is 20% over the legal limit. Frankly, it only makes sense that the higher the number the darker the tint, don't you think?

    Also, I would suspect the officer knows the law. We're trained in that sort of thing, ya know.....

    According to the state law:

    (3) when any side window or rear window is composed of or treated with any material so as to obstruct or substantially reduce the driver's clear view through the window or has a light transmittance of less than 50 percent plus or minus three percent in the visible light range or a luminous reflectance of more than 20 percent plus or minus three percent; or

    According to tint meter readings:

    Interpreting Tint Meter Readings

    The reading on a Tint Meter display denotes the amount of light passing through the glass. For instance, a reading of “35” infers a total visible light transmission of 35 %. If the state you are in has a light transmission requirement of not less than 35% total visible light transmission, then that means that any reading below 35% would fail the compliance requirement.

    This is why I'm wondering why I'm being ticketed for 70, or 70%...and not 30, or 30%?

    Any tint place, 30% is dark, 70% is almost factory

    If you want to tell this to the judge, be my guest, but no one here is interested in you "educating" us on the law, or getting anyone "out of a ticket" that we didn't issue.

    ^^ just merely asking opinions is all...

    If the ticket has the wrong information of what I'm being ticketed for, wouldn't that get thrown out?

    In all probability it is a fix-it ticket. You are not entitled to see a judge. I could be wrong, so contact the court and ask someone there who is familiar with your issue.

    If you are over the 50% tint factor you are illegal. Either take it off or have it retinted.

    It's a non moving violation, and I can either pay the ticket, or contact the hearing officer in three days...

    In your opinion, based on the fact I was ticketed for "TINT70PERCENT", is this even worth going to court about??

    It's a business decision. You pay the fine and fix it or go to court at which point in time you'll most likely have to pay the fine and still fix it anyway. Would you prefer to be out time AND money or just money?

    Well if there's a good chance it could get thrown out then I don't mind trying

    Unless you bought the car new, its irrelevant whether or not you purchased the car that way.

    NYS = 70% light transmittance (30% tint). If its the other way around, the car is pretty dark, and I can spot that with my eyes pretty easily. If he additionally used a tint meter, I'm sure his reading is accurate. I doubt he mixed it up the other way around, thinking you had over 50%, and only had 30%.

    Exactly. It's like saying you bought a car without a license plate and thinking you don't have to have one because you bought it that way.

    When you purchase a car, YOU, the owner, are responsible for ensuring it's up to all legal requirements. If the tail lights were out when you bought it would you just leave them out?
