Pay the ticket and fix the tint. You're not getting out of it. Even IF, say, the officer wrote the wrong percentage number - the judge would simply have him amend the ticket to put the correct number on it, and you'd still get the ticket. People make mistakes, even cops (not in this case, but it happens - we sometimes write something wrong on a ticket, goodness forbid we're human), and judges understand this and we change tickets ALL the time after they're issued to correct such errors.

"But judge, he didn't dot the "i" there, can't you see it!!!????" "But judge, he misspelled my last name - that's an error, he made a mistake, throw it out!!!!" Judge chuckles, officer corrects ticket, you pay ticket.

I also hear that all the time. "Trooper, the car only came with one license plate." Then I tell them, "Your driving, your responsible." Be responsible pay the ticket and Be Safe.

Point of information. Courts exist because people do the wrong thing. Sometimes intentionally, sometimes unintentionally. Your's is an unintentional violation; but, to clarify, "Ignorance of the law is no excuse!"

I would give you a .01% chance that the case would be thrown out. Judges have a tendency to sway their decision towards those who enforce the law as opposed to those who plead ignorance.

Take the tint off of the window, get the violation signed off, pay the fees and don't err again.

Of course, I am basing my decision from a LEO perspective with 33 years of experience. Your choice.

I think you should fight it tooth and nail... all the way to the State Supreme Court if you have to. Check for every undotted i, every uncrossed t, whether the color listed is really the correct name for your cars paint (gold instead of Harvest Champagne). Make sure you appeal every judges ruling against you.

In order to be really effective, you're going to need a good lawyer.

In these tough economic times, cops need every bit of overtime they can get.

I once bought a car with a New York Bar Association sticker on the windshield, so I'm qualified to represent mjar01. I, the Clarence Darrow of my generation, will take the case.

I looked at the ticket, and it lists:

    TINT TOO DARK

And under the comments at the bottom of the ticket it lists:

    TINT70PERCENT

In my state, the legal tint is 50%. According to this ticket, I'm actually over the legal limit. My understanding was, the higher the %, the lighter the tint.

Is this something worth bringing up to the court, that I was ticketed for 70% which by the standard tint percentage, is beyond legal in my state?

    Thanks!
How in heck can anyone tell you the law if we don't know what state you live in ?

Actually this would be an EXCELLENT case for the US Supreme Court.

The issue of first, third and fourth amendment right violations abound with the ILLEGAL issuance of this ticket. Quit your job, contact the ACLU, explain that the Officer violated you right to dull your vision.

    Hope this helps!

Most non-tinted automotive glass has about 75-80% light transmittance, so I seriously doubt that any tinted glass would read 70%.
