    Supervised Move-Out?

    Hello all,

    I'm sorry if this topic was already covered, but I searched for it with no luck.

    My situation is this: My mother's boyfriend is living with her and my 13-year-old sister, but he will soon be moving out due to 'relationship issues' (whatever they may be). He is verbally abusive towards my mom and sister, and threatens my mother often saying things like "I'll have to call up detroit." (referring to some kind of hitman he claims to know) From what I know he doesn't physically abuse either of them, aside of pushing my mom into a mirror some months back and pushing me into some garage junk during a confrontation. Still, she is very scared of him and calls me every once in a while to talk about things. It wasn't so bad during summer because I lived there then, but now I am back in college and I think she does not feel as safe. Unfortunately, this situation has happened once before, and when he moved out he took a bunch of our belongings. I told my mom to have a police officer supervise the move when he moves out (and told her to have him out A.S.A.P. because I fear for her and my sisters safety), but she said that she called the police and they said they would only do that if she paid the officer $50.00 per hour, and my mom does not have that kind of money. My question is: Does she honestly have to pay an officer $50.00 per hour to have them watch the move for both, my family's safety and our belongings? If so, is there any other solution to prevent them from being hurt or our possessions from being stolen?

    I assume they told her the truth, I don't know. We don't stand by for more than a few minutes under any circumstances. We don't hire out officers for it either. But we can't afford to tie up an officer for an length of time for something like that.

    ...and once again, the location of the jurisdiction is not included in a Post where it is imperitive that any adequate answer could be returned to the "asker"...

    What you're referring to is a civil stand-by. We do it, but as was said above, it's only for a few minutes. For instance, if there was a case of domestic violence and the suspect sends his brother by his house to pick up a few things, like a set of clothes, underwear, etc... We'll stand by just so the person can get the stuff, then get the hell out without there being any fights. We won't stay there all day and if they're taking too long, we tell them it's time to leave and move them along.

    Chances are, if he's pushed you before, he's pushed your mother many more times when nobody was around. If she has been abused she needs to report it.

    We won't do a civil standby unless there is a court order. Then it is up to the person holding the order to contract with the agency for a set hourly cost.

    Basically its a personal problem that

    It isn't a police action. If you get a court order and are willing to pay for the Offficer and equipment to be there, go for it. No crime no need for police.
    The early bird may get the worm, but the second mouse gets the cheese.............

    I would suggest that she check with her state's domestic violence laws. In many cases a judge can and will order that a uniformed officer stand by to keep the peace in such a situation. Every agency handles these cases differently and you need to be aware of your jurisdictions policy.

    As others have posted, for a civil stand-by, we will only stay there for a few minutes. Long enough for him to get "necessaties"...a change of clothes and a toothbrush. If your mom wants a deputy there longer, she will need to pay the off-duty hourly rate (my agency charges $35/hr with 2 hour minimum) for a deputy to stand-by to keep the peace. The officer is not there to tell your mom's boyfriend what he can or cannot take, that will need to be brought up in civil court. If there is a history of this man physically abusing your mom, this needs to be reported to police.
    Feel safe at night...sleep with a cop.

    If you run, you only go to jail tired.

    Thank you all for your help, I think I understand the situation a little bit better, atleast as to why they demand the per hour rate. Unfortunately it doesn't really help my situation, but that's really no one's fault. There is really no way of holding on to our possessions then if he so chooses to take them? I know I would not let that kind of behavior go if i was able to be there, but I have school and will not be able to. When I discussed it with her, my mom just said, "I don't even care anymore, I just want him out." Which made me angry, because I know she just says that because she is afraid of him.

    Sorry, I looked at the "Before You Post" sticky to try and make as little error as possible.. I did not see anywhere that it mentioned adding your jurisdiction (though an obviously necessary part of information). I am not part of the law enforcement, nor am I training to be, so even the most obvious elementary questions and/or imperitive information to a question deem themselves difficult for me. I don't even know where to look for my jurisdiction lol (sad, but true). I live in Shawano County, Wisconsin. I'm sure you guys get that a lot, but perhaps there could have been a nicer way to ask for the needed information to give an accurate answer? But nonetheless thank you for your input!
