a friend of mine worked at a gas station she went to pick up her last check the girl behind the counter knew she was short some money and handed her a carton of cigs and said dont worry about paying for them i got it. now shes trying to say my friend stole the cigs when infact she handed her the carton . can she get my friend for stealing even though she didnt steal the cigs?

It's virtually impossible to answer that question based on what you wrote. If the owner contacts the police and wants it pursued, they will interview your friend and they will determine what happens.

What does the "Tale of the Tape" show? Does your friend have a receipt?

If I were your friend, I'd go to the owner and pay for them, because I'm sure that's all that is needed.

The owner/manager isn't going to want to waste his and the other employees time at various court appearances, etc. and still be out the cost of the cigs.
