    Speeding Ticket Given After the Fact?

    I live in California and would like to know the law concerning if a speeding ticket can be issued after I already have both parked and exited the car.

    The police man was not hailing me down the road. I didn't even know he was there until after I had already parked my car outside my house on the street when he then came up on his motorcycle and asked if he could talk to me for a second.

    He showed me he had clocked me in as speeding, and proceeded to give me a ticket. Does it qualify as "entrapment" on his part when asked if he could talk to me?

    I feel like I could perhaps contest this ticket if I knew the law concerning this...thanks so much!

    AS long as I know your the operator I can issue you the ticket up to a year later. There is no "exit your vehicle and your safe" clause. If you were speeding you were speeding.

    No, he can't issue you a ticket. You made it home, you parked your car. You are now on home base and you are safe..just ignore it :rolleyes:

    Entrapment? Look it up in the dictionary.

    I'm guessing he thought asking if he could talk to you was a better way to start a conversation than just walking up and stating "Give me your f-ing license I caught you speeding". So much for being nice.

    And just for info, every ticket we give is "after the fact". The courts frown on it if we cite people for offenses they will likely commit in the future.

    "Your Honor, the fact that I was speeding is irrelevant here. I made it home and I exited my vehicle. He's too late! He asked if he could speak with me, and that clearly entrapped me. I beat this ticket!"

    1. No, it's not entrapment. Entrapment is making you do something that you normally woud not do. He didn't make you speed. He didn't have to ASK you speak with him. He could have simply told you to stay near your vehicle and then just wrote the ticket. He was being courteous in asking.

    2. You were speeding. Why does making it home and getting out of the car all of a sudden make that okay?

    3. You can be issued a ticket for WELL after the actual violation. It can be mailed to you at home or work or personally delivered.

    4. Accept responsibility for your actions instead of trying to find inventive ways to avoid having to do so.

    Inventive? You've seen nothing yet.... I had a woman in court testify that officers were driving in front of her blowing "narcotic smoke" into her car in order to make her speed so I could cite her.

    Then, learn the law. No one in these forums is going to help you provide a defense to a traffic violation. Did you read the rules before posting?

    I will tell you that it is not entrapment! You were not encouraged through unlawful means to speed. That was your choice and voluntarily enacted by you. So, how could it be entrapment?

    If you have a disagreement over the violation then it is your right to plead "NOT GUILTY." Do so! I am certain the nice officer will happily be there to testify to your ever so flagrant misuse of a Californina roadway and a total disregard for the safety of yourself and others by exceeding the speed limit set by much more learned men than yourself.

    I am certain your vast experience as a driver would come into play for your defense.
