    can i be arrested?

    Hi, I have a small issue with a vehicle storage owner in a different state and i need an honest opinion.

    My husband and I were driving down from VA he is currently in the Marine Corp and not once but twice we got stranded our vehicle broke down. We were towed to a gas station/auto repair shop we were going to have the vehicle repaired their but he was double charging us. Everything was going great until we told the owner we were towing the vehicle to CA he did a complete 360.
    1st. He wasn't going to charge Storage fees because they were going to repair it.
    2nd. Before he found out it was going to be towed to CA he wanted to charge me $15 a day. When he found out we were going to tow it and every attempt to get it on a dolly or two-bar he said he wanted $25 a day.

    Its almost been 30 days I have an agreement that the truck could be stored their it has a beggining date but no ending date that says i have to retrieve my vehicle by such and such date or else.
    GETS BETTER:
    The owner called me stating he is running out of storage space and he was going to file papers stating i abandoned the vehicle (which is not true)
    wouldn't he be breaking the agreement so that being i can retrieve my vehicle at any time fees paid or not. Its not a gated storage and i know i risk being sued, but can i get arrested for taking back my vehicle?

    If you husband is in the Marines, contact the JAG office and talk to a lawyer. This isn't a criminal matter, but a civil one between you and that guy. There might be something in the Soldier's and Sailors Act that might protect you, but only a military lawyer can probably tell you.

    Taking the vehicle back without paying probably would get you arrested. I'd either pay and get it away from the guy, or abandon it and be done with it. Depending on the laws in the state he may be able to file that it was abandoned and either sell it or have it crushed after a certain period of time- probably in the neighborhood of 30 days.
