    speeding ticket

    i got pulled over by long beach police for speeding. I got a a ticket for going 48 on a 35 mph limit street according to the officer and ticket. I went back to location where I got pulled over and noticed signs the read 40 mph speed limit! Officer was wrong according to posted sign. Should i go to court and fight ticket or will i get a lesser bail amount?

    Let me get this straight. You got a ticket for doing 48 in a 35 MPH zone; but the speed limit sign says 40 MPH? Forgive me, but isn't 48 MPH in excess of 40 MPH? You were speeding, period!!!

    Minor errors on traffic tickets are common place and do not invalidate the ticket - especially, if you were speeding. Ask for traffic school, pay the fees and forget about this incident. But, slow down so you don't make the same error in the future.

    Before you fight it, make sure you are looking at the location where the offense occurred and not where you got pulled over. If the Officer was sitting stationary running radar, by the time he caught up to you and pulled you over, it may have been in a different speed zone. I'm not saying this is the case, just something to make sure of before your court date.

    exactly what piggy said, check the block number or location on the ticket and make positively sure that the 40 mph sign is for that location. If it is you should take a picture of it, hopefully with distinguishing landmarks around it in that city and if at all possible maybe a mailbox with the address number on it around the speed limit sign. Then go to court and test your luck. maybe it will be dismissed or maybe you'll only get the 8 over its up to the judge.

    we had a rookie officer think that a 40 mph street was 30 mph. Gave a ticket out for 41 mph essentially giving the lady a ticket for 1 mile over the speed limit. She fought it and it was dismissed.
