    What to do? I am at a loss

    I have been living with my mom and her new husband for approximately 5 months now and things have gotten progressively worse since then. I am worried about my Mom because he is violent and an ex drug addict but most important I am worried about my 17 year old brother who is getting smacked and put in choke holds by the guy.

    The first time he got violent with him it was legal because all he did was grab him by the arms because he was trying to get his xbox from there bedroom but ever since he found out Mom won't say anything to stop him he has gotten worse. He constantly talks about how bad he wants to beat his *** or to see him bloodied up by someone else.

    He started to shove and drag my brother to the point that he almost fell down the stair case but luckily I was able to grab him before he fell while I was trying to get the husband to stop. The last time was the worst yet which was yesterday. He decided it was appropriate to smack him across the face and after Mom left because she was upset he drug my brother off the counter he was sitting on and started to choke him with a hold. I was able to stop it before it got any worse but I am really concerned for his safety and I just don't know what to do anymore.

    I've thought about calling the cops but I just don't think it will help any and Mom has already said if the husband goes to jail because one of us she will kick everyone out and stay with her POS husband.

    Hopefully I will be in a place of my own by the beginning of next month and I am hoping to take him with me but they already said they will not let it happen.

    Obviously there is a lot more to the story but I didn't want to fill up a huge post and have you guys lose intrest lol but I am willing to answer any questions but I ask if they are a little to personal you can send me a PM I am not trying to be rude by asking this I would just be more comfortable answering privately.

    You and your brother need to go to the police. Even if you end up in a foster home, it's better than what you have now. He could easily accidently kill your brother with the choke hold.

    I am 24 and I am willing to take him with me when I leave hopefully in a couple weeks but they already said they won't let it happen. I am going to talk to the police tomorrow and find out the consequences if I take him with me.

    Thats what bothers me the most the husband is getting more violent everytime and I am worried about the one time I am not here. He will put the kid in the ER or kill him I honestly believe its not a matter of "if" its "when".

    I would be very tempted to tagteam the POS and beat the crap out of him... ;)

    Tell your mom. Tell the police. Consider pressing charges. Have your brother move in with you - away from the POS. If/when you guys move out, don't be surprised if the POS redirects his POS/violent attitude/nature towards the only person left at home...

    Samuel you could not have said it better. The husband is the type that has to control everything around him and he brain washes Mom with his BS so she will not side with the kids but soon they will be alone and he will beat the hell out of her.

    Every one of the kids has been victim of his anger and mom sits and does absolutely nothing about. Hell he called my thirteen y/o sister a b!tch and he should slap her across the face all because she talked to mom about doing a foreign exchange program for school. Needless to say she doesn't talk to mom anymore.

    He threatened to beat my *** once and I told him it would be the last thing he ever did. He hasn't threatened me since.

    In my state , your brother could file to get an emergency protection order which would EVICT the guy from the house, whether your mom likes it or not. Although your mom can legally toss you out, she cannot do so to a minor.

    I would call the police and your version of child protective services. They have people/lawyers who represent minors at no charge for stuff like this.

    If its the same here I think that is a good idea honestly and I think legally she would have to evict me but I could be wrong.

    I would love to get CPS on his *** he has a 5 y/o boy that he beats and slaps the hell out of to but he doesn't have custody of the kid his mom does. I am not 100 percent sure why he does not have custody but I am assuming it is about his background but I am a bad parent because I let my 3y/o kid cry out her temper tantrums:rolleyes:

    whatever you do, get your brother out of that sinkhole... your mother is an adult, if she stays with the guy that's her choice. Child services is a great way to go, also you should have some sort of Safeplace organization (I think they're nationwide) in your area. You and your brother may have accomodations there.

    The next time he lays a hand on a sibling, step in and challenge him to stop or leave. If he threatens you, you can have him arrested. If he keeps on with the physicality, I'd physically step in. If he fights you, you can have hime arrested. Your siblings cant have him arrested cause they cant sign the complaints - your mother would have to and it doesnt sound like she would. But as an adult you could have him arrested for his actions towards you. There's not law that says you cant protect a familiy memeber who's beeing attacked. If he turns that attack upon you, now you're a victim, too.

    update

    Real quick update as I am writing this on my phone.

    We took my bro down to the police station and filed a report and the officer is putting a report in with cps.

    Now that we did that we are being evicted from the house, they turned off the power to the washer, dryer, microwave, stove and put all dishes and silverware into the spare room. God I love doing the right thing.

    Keep your chin up kiddo, you knew that doing the right thing was not going to be easy. But in the end you know what you are doing is going to make a great positive impact for your brother. Just keep chugging away at it and do what needs to be done. I guarentee your brother will thank you for it in the future. Good luck.

    Here in CA, proper legal eviction via the court system can take months and during that time, the "landlords" are NOT allowed to lock you out or deny you basic utilities (water, power, gas, etc). YMMV but worth a check...

    Thanks for the support guys it may not be much right now now but it still helps to know I am not alone I just wish some of the police here shared the same thoughts but I don't blame them either.

    I am really upset that mom and her husband talked sweet to my brother and he's thinking about not pursuing further actions. Its frustrating that all this is happening and it may have been pointless and I have lost my family to this dirtbag.

    Samuel I think it is the same here with the landlord/tenant rules but I can't say for sure. The worst thing about it is we have 3 y/o and we can't cook for her because the stove is off and the microwave is gone.

    Im going to find out more but its kinda hard right now seeing as the only internet we have is via. Our cell phone and it is a pain in the *** lol.

    CPS should be able to provide some temporary help, at least until you can get established and settled somewhere. Your brother needs a dose of reality. I have never in 33+ years in LE seen it "get better" because the turd feels remorse and promises he will do better.

    As others have said, keep chugging and hang in there.
