So, in regards to the NCIC database and the previous poster about fingerprints:
Does one have the right to refuse to surrender one's fingerprints upon an arrest until a court order?
It would seem that if, regardless of disposition of case they're going to remain in the NCIC database permanently, then refusal would be acceptable until conviction.
Otherwise it would be possible to add more people to the database simply by arresting them and then dropping the charges. (not that I think most cops have any time or inclination to do this, I just see it as a possibility)
