    Pillow Confiscation

So, this is in reference to a news article linked below.

    http://www.detnews.com/article/20090...athers+can+fly

It's really a rather funny story, but long story short, the Detroit Police got wind of a staged pillow fight set to take place in the park and showed up and confiscated pillows so it couldn't take place.

The question is: What would you charge someone with if the refused to turn over, (well, maybe relinquish is a less puny word :D ) their pillows?

    Thanks

Many cities have ordinances requiring permits for events like this. They could be arrested for violating such an ordinance. Technically, a pillow fight is a fight and would also meet the statutory definition of affray or disorderly conduct should the need arise to arrest people who wouldn't comply with orders to disperse.

If this happened in my park, I would kick them out. And if they came back I would write them up for trespassing.

I guess it would depend if it was a lingerie pillow fight.......and then it would depend on who was wearing the lingerie :D
Integrity is doing the right thing even when people aren't looking.

I'm almost sure something like this was in place. I've always found it odd though, that in general the requirement is simply that a permit be on file. There's no expectation that each individual at the event will have a permit. I think I had read a story before about all the people at an "illegal gathering" being charged. Seems like only the "organizers" would be at fault, since they're the only ones who would have been expected to have gotten a permit.

Is it possible to trespass in a public park? I don't mean that to sound flippant, I really am curious.

Parks have hours and rules. These rules of hours and information are generally found on placards through the park.

The park is owned by County, City, State or Federal. They are called "Public" because you are not required to pay a fee to use it, but the (County, City, State or Federal) still own it and can have you removed.

Loitering I believe is the general catch all for the unwanted persons in a park.

Absolutely. If a person is kicked out of a park, and intentionally comes back, knowing that he/she was kick out earlier, that's considered trespassing here in our park.
