    Recording Conversations

    I was browsing some older posts, and came across one where someone was asking about mounting a video recorder in their car. It seemed mostly to deal with video, so it got me thinking about audio.

    It made me a little curious, so I was wondering if you've ever had someone tell you they were recording the audio of a conversation at a traffic stop.

    Would it be acceptable for a motorist to create an audio recording of a police interaction?

    How would you handle it?

    You need to check local state laws. Some restrict recording unless the second party is advised.

    In Arizona, you may record a private conversation if you are a party to the conversation, without notifying. You cannot record third parties.

    I conduct myself in a professional manner on all contacts, so it would not bother me at all if someone recorded me. It has happened before, and I am sure it will happen again.

    My favorite contact was with the "orange shirt" anti-police brutality clowns at an annual "Prison Run." They were such assholes that I could hardly keep from laughing out loud at them while they pranced around with their recording equipment. They want to get a rise out you and when they don't, it irritates the hell out of them.

    Anytime I run across a member of the HA, I always treat the contact as if it is being recorded. And, if nobody else has had it happen to them, it is a bit entertaining to have one of them fill out a FI card on you.

    But, back to your question. I like the idea of someone running a camera in their car. Hopefully it will catch the violation on tape and make my job easier.

    Just dont loose it, because we are gonna suponea it for court.
    You should see the look on their face when you tell them that.
    On a clear night, I can see the other deputies emergency lights at least 10 miles away.
    But it isnt flat here LOL

    Oregon allows recording of phone calls with one party consent, but not face to face. Some states allow both, some allow neither. Whenever I wore a wire while working UC, I had to get an ex parte order from a judge authorizing it. But I kept a recorder on my work phone at all times so I could push the button and start recording as soon as I felt it important.

    When police officer pulls you over here, the first thing they tell you is that the encounter is being recorded.

    It would not be acceptable in Pennsylvania. The person would be allowed to video tape it, but they would not be allowed to record any audio at all. In Pennsylvania, either you have a court order that allows you to record audio, or both parties must consent to it.

    Record to your heart's content here in Texas. Doesn't bother me a bit anyway as, like others have stated, I conduct myself in a professional manner on all traffic stops anyway. Of course I'm always recording as well

    As for the crowd trying to get a rise out of us, it really does get under their skin when they don't do it. They HATE that. All of a sudden the tables turn and they KNOW you're laughing at them inside.

    I've been busy. Plus, I thought maybe less frequent questions would be less upsetting.

    I actually thought for awhile about answering Group9's request for some background information about myself. The problem with that is:

    1) It runs against my long developed habit of never sharing personal information online &
    2) Big seemed so irate with me that the thought sharing makes me a little nervous.

    That and the fact that I am incredibly boring and didn't want you guys to find out!

    Honestly I really haven't been able to figure out why my behavior is so frustrating.

    But I do appreciate when people take the time to post anything at all!

    In Missouri it would be perfectly legal.

    All my traffic stops are being recorded, audio and video, anyway. If someone wants their own copy, that's fine by me.
