    rape

my girlfriend was raped 8 years ago by her own cousin, she never told until about 3-5 months ago and that was to me. he hurt her badly, physically, and mentally obviously.
i finally convinced her to tell her parents and brother after this guy attempted to do it again recently about 10 days ago.
they called the cops and they told her they cant do anything about the first time, because of the timespan. and that there is no proof on the second time, just her word against his.
the second time, he touched her under her clothes while she was sleeping and then tried to continue.
is there anything that can be done? dont tell me this rapist is just going to walk around like nothing happened. he even called her to tell her he enjoyed touching her afterwards, just to hurt her.
please tell me if theres anything at all that can be done. perhaps a way to find proof that this has happened.
im not sure where it happened the first time, but the second time, it was in philladelphia, but we live in florida.
i dont know if we can record a conversation [phone], or confront him personally and record it.

edit: maybe i should point out she still a minor, and so am i.

I may be wrong, but I can't imagine a Beat Cop making the assumption it couldn't be prosecuted but regardless, the passage of time unfortunately boils the fact down to her word against his, unless there is any Evidence to back her up.

Depends entirely on the state laws. In Oregon, a victim has 6 years past their eighteenth birthday to report sex abuse as a child. But I imagine that's about the most liberal. You would have to contact police in the state it occurred. There is no answer for nationwide.
