    Bit A Cop In Self Defense

    Yo. My buddys and I are pulled over and the cop says he smells weed in the car, so he calls for backup and they decide to search the car so we are all standing around. I take a handful of breathmints and this one cop starts screaming at me and slams me on the hood of his car. He yells at me to spit it out and i don't even know what the hell is going on. He just keeps yelling and pounding me on the car and then another cop comes over and they kind of have me in a chokehold and are shaking me. Then one of them sticks his hand in my mouth and almost makes me gag and I think he's going to choke me to death so my teeth bite down on his hand. So the cop goes to the ER for stitches and they forcefeed me this nasty stuff that makes me puke my guts out. It really isn't until I get to the hospital that someone explains to me that they thought I was swalling drugs to hide them. I am charged with assault on a police officer and resisting arrest for biting him. It really wasn't on purpose, I couldn't breath with his hand down my throat. Isn't that self-defense?

    Sounds like you got what you deserved. You're under suspicion for drugs and decide then to swallow some breath ments... very stupid on your part. :rolleyes:

    Why on earth would you come to a board for cops and expect any sympathy with that story?

    The charges will almost definately stand.

    I really don't get it. It's not like I wanted to bite him, but I really had no choice. I honestly thought they were going to choke me to death (not on purpose of course). I couldn't talk, I couldn't swallo, I couldn't breath. And they kept yelling to spit it out, but there was nothing to spit out. I took the mints and swalloed them. There was nothing for me to give them and I couldn't get a word out to explain. Maybe none of you have ever had one guy wrap his arm around your neck and lift your feet of the ground while another guy jams his hand down your throat digging for something that isn't there. Later at the hospital I tried to apologize to the cop about his hand and he just said 'shut up, punk!' and pushed me out of the way. You don't see me running to the police to file an assault charge against him. I took the mints because I didn't want them to smell the alcohol on my breath.

    Swallowing mints?? Is this some new technique to combat bad breath? I keep chewing them. Am I doing it wrong?

    Why would you not want him to smell alcohol on your breath? Drinking and driving? Underage drinking? Somehow I don't think we're getting the entire story here.

    You put yourself in that situation by the people you associate with, and the way you conduct yourself. You gave yourself no choice. Now you're going to have to go convince a judge why you were justified in biting a Police Officer and hope that he buys the breath mint defense which none of us are buying.

    Does that mean that ONE mistake gives anybody the right to do whatever they want with me? It was the cop who made the mistake, probably a justified mistake, but still a mistake.     The cop didn't make a mistake. He thought you were trying to conceal a crime (which you were) and tried to stop you from doing so. The fact that he guessed the wrong crime does not aid your defense.

    I bet if we could see video of the events, we'd see that the officer(s) were yelling at you to spit it out and you were failing to comply with their orders.

    People have been known to swallow marijuana in an attempt to get rid of it.

    And you realize that in order for a mint to change your breath, you need to KEEP IT IN YOUR MOUTH. Swallowing a mint will not help your breath, right?
