I have a question I've always wondered and everyone I've ever asked was stumped too... And no, I'm not planning anything =P What actually brought it up was an episode of Judge Mathis where it kind of happened and the person got away with it so it kind of made me think "what if that was me~!?") However I'm going to explain it in first person just to make it easier to understand....
My question is;
Well, I've never been involved in anything law related but from TV, I assume that when you accuse someone of something and report it to the cops, action is basically always taken, even if the other party denies it (because that's what court it for...)
But like, lets say I hate you because of some stupid irrelevant thing from the past and I want to get back at you but don't want to do something that can get me in trouble. So what I do is decide instead that I will make you pay money by getting you in trouble for no reason. My 'plan' is that I will call the cops and tell them that you did something that you did NOT do that's bad enough to get in trouble for (like lets so I have a big cut/bruise from playing sports or something and I say that you assulted me in my driveway). Obviously because I'm lying, you will eventually go to court and end up being "innocent," but you would have to pay for court fees and possibly lawyer fees...etc. So, even though you were innocent you have to pay for it (I've seen this on TV a million times and the judge usually says it's just 'part of your right to take action and defend yourself'). But what if I did this dirty trick over and over and over again? And so it's not obvious, I make up new things (like maybe I have a huge ding in my car and say we were arguing and you came up and kicked it right infront of me...etc, etc) and though you always get called innocent at the end, you end up paying hundreds and hundreds in court and lawyer fees (and possibly even jail time and bail money because I've seen a million times on TV where if someone has an injury and says another person did it, that person gets arrested right then and there no matter how much they deny it even before they go to court)
So is there anything to prevent this kind of thing from happening?
One person I asked said that you can easily do it to someone and that there's nothing you could do to stop it (so you would have to sit in jail, pay everything...etc), and the only thing you could do is wait till it over and then pay (again) for a lawyer and court fees to sue them for all of it (which still doesnt change the fact that you sat in jail for no reason)...etc
So what's the deal with this stuff? Because it just sounds so easy, yet so hard to prevent (which is really scary!)
