I asked a question several months ago for my friend because he left his 5 yr. old son alone in the middle of the night for about a hr. The cops came and he didn't get arrested, but said would go to court. Well he just got served a letter for a court date. They said he won't get arrested, but they don't know what will happen because it's up to the judge to decide. He either has to plead guilty or not guilty which obviously he's guilty he should plead (I think) but what do I need to tell him? What will happen? He doesn't want to lose his son who he has full time. Please help him!!

1- Tell him he needs to be a better father.

2- Hopefully he'll get some parenting classes that he desperately needs.

3- He should have thought about that before he left his 5 yo son alone for an hour.

IMO, if he was going to lose his son he would have lost him when the original offense occurred. If the officers and/or the state department of children and families felt the child was in danger they would have removed him from the house at that time. Could the judge still order the child to be put in the custody of the state? Sure. He could also order state supervision of the household for a period of time.

The judge can do a lot. Nobody here is going to give you legal advice, so you need to get a lawyer.

What do you tell him? Are you kidding me? If he's not bright enough to know a 5 year old shouldn't be left alone, tell him he's a retard. No sympathy here.
