Kubotans and their legality in NY

This one goes out to any and all LEO's in NYS: would you charge someone with posession of a deadly weapon if he was found to have a kubotan on his keychain? The reason I'm asking is a friend of mine showed me his the other day, he bought it in a head shop I guess. FYI if you don't know what they are, it's a 4 to 6 inch long little wooden or aluminum stick that you keep on your keychain. They're self defense type weapons, and are applied to pressure points on an attackers' body. I looked into the penal code, and cannot decide whether or not these fall into the criteria.

Its all relative to the situation. Could it be charged? Yes. Its all about the totality of the circumstances.

The mere possession probably would NOT be charged as weapons possession, BUT if you were arrested, or stopped and it was discovered, the situation could change depending on too many variables to give a definite answer.
