recently my friend was arrested for having a bowl in his car. he was arrested for this six months prior to the recent arrest. first time he was let go with conditional discharge i think it's called. what are the chances of them going to jail?

Your 'friend' has an excellent chance of seeing the inside of jail this time around.

An ACD (in NY) is adjournment contemplating dismissal, meaning you stay out of trouble, and the arrest becomes a sealed record, you get arrested again, and they can reopen the prior arrest for resentencing because you haven't satisfied the requirements of the sentence (staying out of trouble).

Ask the judge. We arrest, not sentence. Since this is not a first offense, your "friend" has helped to increase his odds of jail this time.

actually he is not a loser..he is a really good person who i don't want to see get his life ruined..he actually wanted to be a cop..but thanks for all your help..you guys suck
