    Question Who's at fault in this situation?

    Today around 2:15 i was leaving school with my friend in my friends car, it's usually a busy road so whenever someone gets the chance to pull-out they do(i know it's not the safest thing) and there's supposed to be a cop at the bottom of the hill where there wasn't today. Anyways, looking right, there was no cars, look left and there was one car about 60 yards away with his right blinker on (pulling into the school) so my friend decided to pull out. As he's pulling out the car keeps going straight, so my friend quickly scooted across to the other lane, and the other car crossed over the center line, and crashed into him. He was an older man, probably in his 70-80's.Who's at fault? :confused:

    Speed limit on road is 40 or 45 not quite sure.

    Your friend is at fault. Vehicles already in the roadway have the right of way and for thelove of god stop posting in your own thread before you make your stay here a short one.

    I only did so i could post the picture, and that's what I thought, but does it matter at all that he had his blinker on, or that he swerved into the opposite lane?

    no, and he could've been going 70 mph, still doesn't matter...oh yeah and he could've been drunk, it's still your "friends" fault...

    Your pal at the stop sign has a duty to yield to ALL traffic on the highway. To assume that an approching vehicle is going to turn because it has it's signal on is risky.

    I would indicate that your pal was the #1 reason for the crash and if I could substantiate that the other guy did have his signal on, perhaps I would have indiicated a lesser violation on him.

    Usually, when someone is going to turn they slow down and start to move over towards the curb. Looks like your pal just went for broke...and got broke.
