    Not from NM, but no, a repo man cannot enter a closed/locked garage to repo your car.

    An open garage or carport is another story. The parking lot at your work as well.

    Trust me, it's not like you can leave it parked there forever; you will end up driving it somewhere and they will get it. Or the bank will sue to get their property back, and the sheriff will enforce the judgement.

    I think the advice he was trying to give you, is be responsible. If you don't spend outside of your income you can pay your bills on time. If you pay your bills on time, the repo man doesn't go into your garage and take your car. If you don't like the fact he went into your garage, you'll have to sue them in civil court. If you have the money to pay for an attorney to sue them in civil court, you should have used it to make your car payment. If you can't make your car payment, sell the car. If you can't sell the car, call the bank and make arrangements to turn the car back into them so the repo men don't have to hunt you down to take your car back because you were too irresponsible to make the payments.

    Does that help make things a little more clear?

    Yes, but it takes a little work on the repo man's part, requires a separate court order and the assistance of the sheriff's office or other law enforcement agency. Basically if they can establish that you're withholding the property from a lawful repossession, the court can issue a warrant to forcibly enter your garage in order to take custody of the property. In many states it's also a criminal offense to knowingly obstruct the actions of a repo man by concealing or hiding property once you know it is subjected to repossession.

    In Arizona they would not be able to enter an enclosed structure. In the carport, back yard, front yard, work parking lot, store parking lot, etc., they see it, they can snatch it. If your garage door was open, then they can snatch it.

    Now, there is a new law in Arizona (I don't have the foggiest about New Mexico) that once you have been officialy notified of intent to repossess, a criminal charge can be filed which would allow a search warrant to be issued for enclosed areas.

    With all the alternatives out there to avoid repossession, not a lot of us have sympathy for those who just stop making payments, yet use the vehicle, then whine when it gets taken away by the rightful owners.
