Different communities place different values and emphasis on some enforcement action, and I think he'd be in a better position to answer how PC smoking is in your area than most of us.

As being a manager in the past I see it diffrent. How old are you and what are you going to manage? As a manager, you shouldn't have to ask that question. people are going to look at you for the answers. Would you let them break other laws on a break??? theft, drinking alcohol, drugs? Then why smoking. I would tell them that they will be warned once, with a phone call to their parent. Written warning a second time. And recommended for termination a 3rd time. They are representing your business, want them smelling of smoke?
It is contributing to a delinquent of a minor if you but cigarettes for them, it also is if you "house" their illegal activities with knowledge. By letting them smoke and being in charge, you have an obligation. It would still be contributing to a delinquent of a minor in my book.

I understand what you are saying but my head manager allows them to take smoke breaks and has never had a problem with it so I don't see how writing them up would do anything other than covering my arse.

It sounds like your going to be a manager, not a "head manager." Manage the resturant and keep it at that. If the smoking becomes a problem for the resturant (like customers complaining, too many breaks, bad odor) then adress it, if not, don't. Thats just my opinion, laws in your area may differ. The "head manager" should bear the responsible for this problem, as he has fostered it.
Smoke breaks are allowed,,,if you are of age! Im a parent and if I found out that while my kid had a smoking problem, and that he was allowed to do it at work with the management approvement...(because if mgt. knew and are allowing it, its approval- technical word is "Silent Approval") I would be highly pissed off. Yes, a lawsuit could happen along with criminal charges. Others on this board may thing I'm off on this but believe me...when this got to the public I guarentee the higher ups in your restaurant WILL make changes and examples of the management in order to show the public that they were not aware and will not stand for it.
Look what happens when a teacher does something that is not popular with the public...boink...gone or suspended pending investigation.
I find out my kid is allowed to smoke at work,,,I make fuss...investigation starts...they will all take up for themselves...well so and so smokes and the management allows it. $$$$$$$$$. You will see.
Christ bartenders are responsible for serving a minor if they do not check age, just like responsible for serving someone that they think are intoxicated. Also responsible if they SHOULD OF KNOWN the patron was drunk and is involved in a car crash. Look up what negligent retention is.
