Question Freedom of Press still in Constitution?

I believe we all have seen videos of police attacking journalists when the journalist is simply attempting to do their job and record an incident.

Why are the police getting away with this? It is written that we should be "free" in this country, but how come we (tax paying citizens) cannot use video to record police action?

Before anyone pulls the "ongoing investigation," "private property," or other nonsense, I know about the common sense reasons, but we used to be allowed to record anything in public. Why the violent and what should be illegal forcing of filmers to stop?

You should take pictures of burning houses. Firemen love to be filmed.

In response to your question, your premise is flawed.

    # 1. You must be with the press for freedom of the press.
    # 2. You can film just don't get to close to an officer performing his or her duties.
    # 3. Read 1 and 2.
    # 4. You put yourself as subject of arrest and video confiscated when you can't follow #2 and not #1.

I haven't heard of a journalist doing their job in years. They are supposed to report stories based upon their own research. When was the last time you ever heard about that happening?

If you want to post a specific example, feel free to do so. Otherwise you aren't going to get much of a response here.

Plenty of case law establishes that anyone has the right to record police officers engaging in their duties on the street. In fact, anyone can be recorded on a public street as there is no expectation of privacy in public. However, that doesn't mean that the people recording the activity do not have to follow the instructions of the officers on scene. Just because you have a video camera and are recording police activity does not give you the right to do things that other people cannot do.
