    Question about a DUI ticket??

    I got a dui ticket on December 6, 2002 and it has now been over a year since I was pulled over. I have still not been to court over this ticket and I was wondering how long is ticket is good for? I mean, is there a certain amount of time the ticket can be on my record like, if 3 years go by is the ticket still good? Is there a chance 3 years down the line I will be summoned to court or something? I live in Missouri by the way. I greatly appreciate if anyone can help me.

    First of all , DUI is not a ticket or a citation. It is at least a misdemeanor which would arrive as a summons from a criminal complaint.

    Odd that you havn't gone to court by now. Do you have an attorney involved ?

    Did you move since your arrest and perhaps didnt' get a supboena? If so, there is probably a warrant out for your arrest as we speak.

    You NEED to call the court, the officer who arrested you etc to find out what is going on.

    If you genuinely slipped through the cracks, you MIGHT get your case dismissed due to the speedy trial law.

    No attorney is involved, I do not have a warrant on me and I am afraid to talk to any of the local boys about the situation. I am also avoiding talking to the officer that arrested me because, we both do not get along and I don't want anything to esculate into further problems.

    Oh yeah, and the cops know where I live because, I am on supervised probation and I have to report into the Sheriffs 7 days a week and nothing has come about this DUI on my record.

    I think it would be prudent to ask. Unless YOU delayed the trial or court hearing, it sounds like they blew the speedy trial rule.

    Is the supervised probation from the DUI ?

    Did you go through a probation program INSTEAD of going to court ?

    i wouldn't be asking a bunch of cops. i'd be speaking to an attorney.

    A speedy trial rule would only apply if she has already been charged with a crime. If there was no summons or subpeona, there probably have been no charges at this point.

    My question to Cowgirl is, did you give a breath sample or did they take a blood/urine sample. That may somewhat explain a delay if there was lab time involved.

    Actually I believe I refused to take a breath test but, I really cannot recall if I were even asked. I have talked to an attorney and they said if nothing comes about it then I have nothing to worry about. They said, that maybe they could have forgotten to follow through. It's been 5 1/2 months since I talked to an attorney about it. It's just something that I worry about and it is always on my mind. I was on probation for a previous DUI when I was 19 and I was under the zero tolerance deal. I wound up getting a 2nd DUI and couldn't see that I had a drinking problem. That is how I got supervised probation. Then, I landed a 3rd and I really have no idea how I managed to get a third but, I did and this was all at age 20.
    I can say I have been clean and I am on strict probation. I cannot be around a person that drinks, can't be at a place that sells alcohol or serves, I cannot hang around a person that is under the influence and I am not allowed to handle alcohol even though I got permission from my P.O. to work at a Gas Station that sells alcohol. I just am scared that this 3rd DUI can come around when I least expect it and I am not ready to go to Prison.

    Do you drive still?
    In NY, if you refuse the breathalyzer, your license is automatically revoked for a year.
    I just wonder if you missed some communication from the court about your court date. If I were you, I'd ask your PO if you have a warrant or the status of your DL.
    I know you say you report in 7 days a week, but sometimes the two branches of the law don't really talk to one another.

    No I gave up driving. I get my license back in 2008. As you can tell I had a bad drinking problem. I have been clean for sometime now and I have no plans on drinking and driving again. I've learned my lesson and am still learning as I go. Thanks for the help!

    Yes the third is a felony but, I'm not a felon as of yet. I plan on keeping it that way too.

    How can you get out of being a felon? What did you blow each time? You should know this - in fact, you should know every detail about each of the times. That would make me feel like you understand the seriousness of the matter.
    As far as 'giving up your license' - I'm sure it wasn't voluntary. I would be suprised if you got it back so quickly, to be honest. I think they should keep it for longer than that.
