    False Identification & "Avoiding" Police

    I have two questions.

    First, where can I find information on Oklahoma law regarding possession of false identification such as a driver's license? Or does someone here know what the law says. I have not been able to locate any relevant websites...

    Second, someone I know was recently pulled over for "avoiding police". Apparently he saw a cruiser while driving and for one reason or another avoided him by going a different direction. I do not have all of the details of what he did (I can find out), but does this sound right? Can you get pulled over for avoiding a law enforcement officer? Sounds like horse **** in my opinion.

    Any feedback would be appreciated.

    Possession of false ID is a crime in EVERY state.

    You need to know ALL of the details of your friends incident but...don't expect him to be truthful either. In PA it is a crime to flee or attempt to elude the police. Does not require a chase, someone can elude at 25 mph.

    mcsap: I am well aware that possession of false id is illegal. However, I do not know what the law says about it in regards to minimum punishment, which is what I was implying.

    I'll ask his girlfriend today at work regarding the violation. I don't imagine he did anything illegal *to* elude the officer. I'll post more tonight if I get any new information.

    I once pulled into a gas station after i saw a cop coming after me. He pulled in behind me and said i was trying to lose him. I told him that he knew this area better than me (i was just driving through) and it would make no sense for me to be driving around getting lost and I parked in front in full view of the highway. Nevertheless he probably didnt believe me but i didnt care i knew i was getting the speeding ticket anyways. No ticket or anything for "evading" if i had have gotten one or arrested i would have wished i actually had.

    Trying to lose him by pulling into a gas station and stopping? That's the best way to go about it Unless you're leaving something out, the cop must have been a doof.

    In any case, I do not understand why police are given the authority to determine whether or not they are being eluded while not engaged in a pursuit. In many, many occasions I have been lost trying to decode a poorly generated map... imagine if a cop was behind me as I pulled onto a street and stopped to figure out where the hell I was, as I have many times done.

    We are given power to ARREST. Take a persons freedom away. This is a SERIOUS responsibility that is NOT taken lightly! Everything we do in this area has to be backed up with probable cause and or reasonable suspicion that a crime has occurred. We never find anyone guilty, only charge them if we do find evidence of a crime by raising our right hand and signing our name that it is true and lawful to the best of our ability.

    I do this for a LIVING. I don't make things up or arrest people for grins. If I did, I would be working in some warehouse. I have been given an enormous amount of trust and responsibility by those in authority over me. Those in my profession who screw this up don't last.

    Get your facts ( if you can) and re-visit us for more dialogue.

    I dont know what his thing was, I think he just wanted me to wait until he was behind me with his lights flashing pretending i didnt' see him or something (or maybe he wanted me to be "afraid").

    Oklahoma law requires a red light and siren from the police officer and the citizen to attempt to elude the officer before there is a crime here.

    Of course, "avoiding" the police officer could possibly be probable cause for a stop, depending on for example, the area they were in (high crime area, drug sales) or another example is the officer could be responding to a call in the area like burglary and seeing a vehicle leave the area and make a quick turn when they saw the police would be reason enough for a stop.

    Sorry, there was a major error in information on my part. Apparently he didn't get a ticket, he was just pulled over.

    This was late at night. He was driving down a street and saw a cop parked ahead, so he took a left turn into a parking lot and went the other way. When the cop pulled him over he made up an excuse that he forgot something at his house that he needed for where he was headed. So the cop just followed him back to his house and no ticket was issued.

    This was news to me, though. I never imagined that le could pull you over just for eluding to attempting to elude them. That allows for a lot of error in judgment.

    What part if it don't you buy?

    Seeing as how the police *can* do this, I see how he had probable cause to pull him over, whether I agree that they should be able to or not.

    It was late at night... close to midnight even. You see a car approaching, and as he comes within a viewing range, he pulls into a parking lot, turns around, and drives the other direction.

    By those quotations you seem to be implying that this happened to me? The first part of my initial post was in regard to myself, the latter part was not. This happened to the boyfriend of a close friend of mine just last week, Wednesday I believe.
